City. Park dedication will consist of a cash payment. The required Tree Preservation and <br />Landscal~ Plan has not yet been received by the City; however, the developer has been <br />working With Parks/Utilities Coordinator Boos on this issue. The preliminary plat <br />recommends that Krypton Street N.W. be extended across the County ditch as a through <br />street. The developer has applied for the necessary permits to facilitate this crossing. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmcmber Zimmerman to adopt <br />Resolution g94-03-056 granting final plat approval to Chestnut Ridge contingent upon <br />providing a tree preservation plan and complying with LRRWMO permit requirements. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Peterson, Zimmerman, <br />Beyer and, Hardin. Voting No: None. <br /> <br />Case #17: <br /> <br />Request for a Conditional Use Permit to Establish and Operate <br />a Self-Service Storage Facility in the B-3 Highway Business <br />District; Case of William Dubats <br /> <br />City Administrator Schroeder stated that Mr. Bill Dubats is attempting to acquire Lot 3 of <br />Riverside'West to establish and operate a self-storage facility. Contingent upon meeting <br />DNR approval, Staff is recommending approval of this CUP. Mr. Schroeder noted that <br />this proposal is within the tax development economic district but not in the tax increment <br />financing ~strict. The tax proceeds continue to go to the local jurisdictions. Since it is in a <br />TIF development district, we have suggested within the development agreement that the <br />City's economic development agency could contribute toward development of the project. <br />Staff is suggesting the developer double the tree planting plan. We are proposing to cause <br />the developer to put improvements in place and the City would pay the developer back a <br />portion of'the cost. Drainage concerns amount to about three percent of the project cost. <br /> <br />Councilmcmber Zimmerman stated he would be in agreement with the use of the property, <br />but he has reservations about paying for some of the screening. He felt this would be <br />"opening up a can of worms" and the City will have everyone asking for money for this <br />type of thing. <br /> <br />Councilmember Beyer agreed with Councilmember Zimmerman's statement and suggested <br />that the money is intended for drainage improvements, etc., not planting. <br /> <br />Motion by Councilmember Peterson and seconded by Mayor Gilbertson to adopt the <br />findings of fact relating to William Dubats' request for a conditional use permit to establish <br />and operate self-service storage facilities on Lot 3, Block 3, Riverside West. <br /> <br />Motion failed. Voting Yes: Mayor Gilbertson and Councilmember Peterson. Voting No: <br />Councilmembers Beyer and Zimmerman. Abstain: Councilmember Hardin. <br /> <br />Mr. Schroeder understood that the concern expressed by Councilmember Zimmerman was <br />with regard to the landscape portion of the findings of fact. <br /> <br />Councilmember Zimmerman stated that this money should be used to participate in more <br />major items such as roads, sewer, etc. <br /> <br />Mr. Schroeder stated that it appears there is a consensus with regard to providing funds for <br />drainage. <br /> <br />Councilmember Zimmerman added that if Mr. Dubats meets City Code with regard to <br />screening '.and there is no subsidy for that by the City, he would vote for approval of the <br />findings. <br /> <br />Mr. Sehroeder suggested amending paragraph 5 of the findings and to amend the <br />development agreement related to the screening and City subsidy of it. <br /> City Council/March 22, 1994 <br /> Page 11 of 14 <br /> <br /> <br />
