Voting Yes: Mayor Gilbertson, Councilmembers Peterson, Zimmerman <br />and Beyer, Voting No: None. Abstain: CouncilmemberHardin. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Peterson to adopt <br />Resolution g94-03-058 approving the issuance of a conditional use permit, as amended, to <br />William Dubats and declaring terms of same, contingent upon certification of the variance <br />to impervious surface area restrictions by the Commissioner of DNR. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Beyer, Peterson and <br />Zimmerman, Voting No: None. Abstain: CouncilmemberHardin. <br /> <br />Screening :will be that required by the City Code and there will be no subsidy for screening <br />given by the City. The City will contribute with regard to the drainage. <br /> <br />Case #18: Request for Site Plan Approval for the Construction of Self- <br /> Service Storage Facilities in the B-3 Highway Business <br /> District; Case of William Dubats <br /> <br />City Engineer Jankowski stated that this property is in the Critical River Overlay District <br />and is resa-icted to 30 percent impervious surface area which includes structures and <br />pavement. The site plan proposes approximately 88 percent impervious surface area. A <br />variance txas been properly applied for and granted; however, it will not become effective <br />unless certified by the DNR. The intent of the 30 percent impervious surface restriction is <br />to prevent pollution of the river from surface water runoff. To mitigate surface water <br />runoff, Mr. Dubats has agreed to install a detention volume on the site consisting of a <br />trench lined impervious surface area development. In exchange for this added site <br />improvement, City Staff has negotiated an agreement with Mr. Dubats to reimburse him <br />$6,700 to defray the cost of constructing the detention volume. <br /> <br />Council noted there needed to be changes made to the Development Permit regarding the <br />tree screening as Council did not approve a City subsidy for such. <br /> <br />Motion by Mayor Gilbertson and seconded by Councilmember Zimmerman to approve the <br />proposed site plan for self-service storage facilities on Lot 3, Block 3, Riverside West, <br />contingent upon DNR certification of the variance to impervious surface area and the <br />applicant entering into a development permit agreement, as amended, with the City. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Zimmerman, Beyer and <br />Peterson. Voting No: None.
