Case 02: Application for Off-Sale Intoxicating Liquor License by Easco, <br /> Inc. <br /> <br />Mayor Gilbert,son turned the meeting over to Councilmember Peterson. <br /> <br />Councilmember Peterson stated that application has been made for an off-sale intoxicating <br />liquor license by Easco, Inc. to be located at 6131 Highway #10 N.W. <br /> <br />Councilmember Peterson closed the regular portion of the City Council meeting at 7:26 <br />p.m. in Order to conduct the public hearing <br /> <br />Public Hearin~ <br /> <br />Presentation <br /> <br />Police Chief Auspos stated that he has received most of the information required by City <br />Ordinance and for that which is still pending, he has informed Mr. Eason that final <br />approval would be contingent upon supplying that missing information. He recommended <br />that Council approve the Easco, Inc. liquor license application contingent upon supplying <br />the remaining information required by City Ordinance, proof of liquor liability insurance, a <br />copy of the terms of the lease agreement, and creation of a separate parcel for the address of <br />6131 Highway #10 N.W. <br /> <br />Adjournment <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to close <br />the public hearing. <br /> <br />Motion carded. Voting Yes: Councilmembers Zimmerman, Beyer, Hardin and Peterson. <br />Voting No: None. Abstain: Mayor Gilbertson. <br /> <br />The public hearing closed at 7:27 p.m. <br /> <br />Council Business <br /> <br />Councilmember Peterson called the regular portion of the City Council meeting back to <br />order at 7:27 p.m. <br /> <br />Councilmember Beyer inquired if the City could require that a minor subdivision be done <br />because .the split was never recorded. <br /> <br />Zoning Administrator Frolik offered that Mr. Gilbertson plans to provide a $500 financial <br />guarantee to assure that the lot split is recorded. <br /> <br />City Attorney Goodrich stated that there is a registered land survey so it is not all metes and <br />bounds. <br /> <br />Chief Auspos suggested having the City Attorney review the terms of the lease agreement. <br /> <br />Motion by Councilmember Hardin and seconded by Councilmember Zimmerman to grant <br />approval to Easco, Inc. for the liquor license application, contingent upon him supplying <br />the remaining information required by City Ordinance which includes a proof of liquor <br />liability insurance, a copy of the terms of the lease agreement as approved by the City <br />Attorney, and placing a financial surety with the City to ensure that the lot split to create <br /> <br />City Council/April 12, 1994 <br /> Page 5 of 11 <br /> <br /> <br />
