Absent: Mayor Gilbertson and Councilmember Beyer. <br /> <br />Motion by Councilmember Hardin and seconded by Councilmember Peterson to adopt <br />Resolution g94-04-075 approving the issuance of a conditional use permit, based on <br />Findings of Fact #0359, to Ty Ritter of KRS Investments to expand the outdoor <br />recreational facility at 14622 Ferret Street N.W. <br /> <br />Motion carried. Voting Yes: Councilmembers Hardin, Peterson and Zimmerman. Voting <br />No: None. Absent: Mayor Gilbertson and Councilmember Beyer. <br /> <br />Case #5: Request for a Conditional Use Permit to Grade and Export <br /> Soils; Case of Sidney Nyhusmoen <br /> <br />Zoning Administrator Frolik stated that the City received an application from Sidney <br />Nyhusmoen to grade and export soils from Lot 1, Block 1, HY-10 Ramsey 4th Addition. <br />He is proposing to strip the topsoil, export approximately 14,730 cubic yards of material, <br />and replace the topsoil. The subject property has a wide range of topography elevations <br />and the Applicant has stated that the grading and exporting of soils will prepare the site for <br />future development. The grading plan proposes no importing of fill materials, no blasting <br />and no 'impact to drainage. The Planning Commission and City Staff are recommending <br />approval. <br /> <br />Motion by Councilmember Hardin and seconded by Councilmember Zimmerman to adopt <br />Resolution g94-04-076 adopting Findings of Fact g0360 relating to Sidney Nyhusmoen's <br />request for a conditional use permit to grade and export soils. <br /> <br />Motion carded. Voting Yes: Councilmembers Hardin, Zimmerman and Peterson. Voting <br />No: None. Absent: Mayor Gilbertson and Councilmember Beyer. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Hardin to adopt <br />Resolution g93-04-077 approving the request for a conditional use permit to grade and <br />export soils from Lot 1, Block 1, HY-10 Ramsey 4th Addition and approving terms of <br />same. <br /> <br />Motion carded. Voting Yes: Councilmembers Zimmerman, Hardin and Peterson. Voting <br />No: None. Absent: Mayor Gilbertson and Councilmember Beyer. <br /> <br />Case #6: Rum River Hills Sketch Plan <br /> <br />City Attorney Goodrich stated that Mr. Bill Dorn has proposed an addendum to the <br />Development Agreement for Rum River Hills. City Staff reviewed it and made <br />amendments to that agreement. Mr. Goodrich presented Council with the final addendum <br />to the Development Agreement. The developer is proposing to have town houses <br />constructed in an area designated for single family homes. Mr. Goodrich summarized the <br />agreement and stated that Staff is recommending adoption of the addendum. <br /> <br />Mr. Dorn stated that he has had meetings with Staff and expressed his gratefulness for their <br />assistance.
