Mr. Jankowski felt that the City needs to get an appraisal unless his property is worth less than a nominal amount. Mr. Deemer stated that we are getting closer to it - 66' of it is free, and added that now we are working out where it is. Mr. Schroeder stated that the City will give a description of what is needed to be purchased. The City is attempting to set up the calendar of events to keep things moving. We will wait until the end of the comment period before we proceed; then when the City receives approval, Evergreen Services will be ready to go. Motion by Councilmember Peterson and seconded by Councilmember Beyer to authorize an amendment to Evergreen Land Services, Inc. contract, at a not to exceed price of $8,500, to include appraisal/acquisition for four property owners in conjunction with the Sunwood Drive road alignment. Motion carded. Voting Yes: Mayor Gilbertson, Councilmembers Peterson, Beyer, Hardin and zimmerman. Voting No: None. Case #4: Authorization for Staking on Phase II; Sunwood Drive City Engineer Jankowski stated that the construction of Sunwood Drive is being divided into two phases with the first phase being the segment between Wood Pond Hills and County Road #57, which is scheduled to initiate construction this year. Phase II is the portion between County Road #57 and County Road #116, currently scheduled for construction to be completed in 1996. Mr. Jankowski stated that Waste Management (WM) will be completing the work associated with the final abandonment of the landfill. A considerable amount of grading will occur and WM has agreed to perform the rough grading!associated with Phase II. He added that in order to accomplish this rough grading, a substantial amount of grade stakes will be required. Since the proposal approved by City Council specifically limited the authorization for staking to Phase I of the project, Staff is requesting that this authorization be extended to Phase II to take advantage of the grading that will be performed at no cost by Waste Management. Hakanson Anderson is estimating the cost of the staking to be $5,435. Motion by Councilmember Zimmerman and seconded by Mayor Gilbertson to adopt Resolution g94-05-082 amending contract for engineering services for Sunwood Drive N.W. Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Zimmerman, Hardin and Peterson. Voting No: Councilmember Beyer. Case #5: Eminent Domain Authorization for County Road #116 Trailway City Engineer Jankowski stated that the City has been proceeding to acquire land from the Ken Laws' property in order to facilitate a trail which will run from Anoka to the Ramsey Elementary School. The City has retained Evergreen Land Services to approach Mr. Laws in an attempt to negotiate acquisition of approximately 0.23 acres which runs a distance of approximately 340 feet through Mr. Laws' property. Mr. Jankowski added that in the event the City is unable to reach a negotiated agreement, eminent domain proceedings must be initia~ ed within 90 days of the time access to the property is required.
