Motion by Councilmember Peterson and seconded by Councilmember Hardin to adopt <br />Resolution #94-05-104 approving the issuance of an interim use permit for a home <br />occupation at 14794 Krypton Court N.W. <br /> <br />Further discussion: Councilmember Hardin suggested that Ms. Frolik contact the City of <br />Maple Grove to see if there are any complaints on file against Ms. Dempsey's business. <br />Ms. Dempsey stated that she sent a letter to City Staff listing names and numbers of her <br />present neighbors to contact for comment about her business. She requested a conditional <br />use permit be issued on the say of her present neighbors in Maple Grove. Councilmember <br />Beyer stated she is opposed to an interim use permit. Mayor Gilbertson felt that Ms. <br />Frolik's recommendation for an interim use permit was fair. Ms. Dempsey inquired about <br />additional charge for another public hearing, etc. Ms. Frolik informed her that the money <br />would be held in her escrow account to cover any additional expenses. Councilmember <br />Beyer inquired if the Planning Commission approved of an interim use permit. Ms. <br />Dempsey stated the Planning Commission felt an interim use permit was unusual. <br />Councilmember Beyer expressed concern that this action would incur more cost for Ms. <br />Dempsey. <br /> <br />Motion carded. Voting Yes: Mayor Gilbertson, Councilmembers Peterson, Hardin and <br />Zimmerman. Voting No: CouncilmemberBeyer. <br /> <br />Case #4: Request for Revised Final Plat Approval of Chestnut Ridge; <br /> Case of Good Value Homes, John Peterson <br /> <br />City Engineer Jankowski stated that on March 22, 1994, the City Council granted final plat <br />approval to Chestnut Ridge. That approval was given contingent upon the developer <br />obtaining a permit from the Department of Natural Resources (DNR) to cross Wetland #2- <br />l14P in order to construct Krypton Street N.W. as a through street versus a cul-de-sac. <br />The permit was denied by the DNR. Mr. Jankowski summarized the following options: 1) <br />appeal the DNR's permit denial; 2) revise the final plat to include a cul-de-sac instead of a <br />through street; 3) bridge the DNR jurisdiction; or 4) push off making a final decision by <br />revising the final plat and creating a parcel of land with an outlot that would allow for a <br />through street or a future cul-de-sac. <br /> <br />City Administrator Schroeder suggested inquiring of the developer, Mr. John Peterson, his <br />opinion of the options. Mr. Schroeder stated that Council has to be cognizant of the impact <br />upon the City's collector road system. <br /> <br />Mr. Peterson stated this project has become a "deadlock" between the City of Ramsey and <br />the DNR, The option of temporarily stopping the development with the idea of at some <br />point convincing the DNR that the little creek can be crossed would be stopping the <br />development somewhat short and leaving an outlot - that is not our first choice. "I see little <br />or no hope that we will convince DNR to change their minds." Building a bridge for <br />$50,000 to $60,000 is not feasible on these few lots plus it would send a lot of traffic from <br />our development. Mr. Peterson stated the cul-de-sac option is the option he prefers. He <br />suggested approving the plat with a cul-de-sac significantly longer than minimum. Since <br />it's a unique situation (a hardship) it may be possible to be granted a variance. <br /> <br />City Attorney Goodrich stated if there is to be a variance request, it has to go back to the <br />Planning Commission for a recommendation and then come back to Council. This variance <br />would not be handled by the Board of Adjustment because it deals with plat development. <br /> <br />Mr. Jankowski commented that the Planning Commission has seen the cul-de-sac proposal <br />and they prefer a through street. <br /> <br />City Council/ May 24, 1994 <br /> Page 8 of 13 <br /> <br /> <br />
