Mr. Schroeder stated that there is currently a path filled in across the creek that someone put <br />in years ago with an 18" culvert under the filled area. There is no evidence to show that the <br />path ever washes out. What was originally proposed was two 4-foot culverts in place of <br />the 18" long culvert which DNR denied. The next proposal was for two culverts and the <br />roadway to be reduced from 32' to 24' while you cross the ditch and then wider after you <br />cross. DNR also denied that proposal and suggested putting in a bridge. Mr. Schroeder <br />stated he met with the DNR and they are aware "we have a problem with this". A <br />developer should have a chance to fully develop land. The City has to be concerned with <br />the impact the road has on the public health and safety of all residents. Sunwood Drive <br />N.W. would be viewed as unnecessary because there is the other road (Krypton). There <br />would be an obstructed single lane access. Krypton Street N.W. has an effect on <br />Sunwood Drive - Sunwood Drive has an effect on the community - the City needs <br />Sunwood Drive. "This is an unreasonable situation to be in but that's where we arc." <br /> <br />Councilmember Peterson stated that he originally made an application for this plat showing <br />a cul-de-sac and the Planning Commission.considered it. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beyer to send this <br />issue back to the Planning Commission with the direction that a variance be considered in <br />granting a 1,400 foot cul-de-sac to Krypton Street N.W. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Peterson, Beyer, Hardin <br />and Zimmerman. Voting No: None. <br /> <br />Case #5: <br /> <br />Second Reading and Adoption of an Ordinance Amending <br />Chapter 7, Section 7.61 Entitled "Lawful Gambling" of the <br />City Code of Ramsey, Minnesota <br /> <br />Finance Officer Hart stated that she has heard no additional comments from gambling <br />managers regarding the content of the revisions of Chapter 7, Section 7.61 entitled "Lawful <br />Gambling". The proposed ordinance calls for establishing the contribution percentage by <br />resolution. She asked Council to act on that resolution setting the amount at three percent <br />of net profits. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to adopt <br />Ordinance g94-05 amending Chapter 7, Section 7.671 Entitled "Lawful Gambling" of the <br />City Code. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Zimmerman, Beyer, <br />Hardin and Peterson.
