Mr. Schroeder stated thai the City has no choice but to put this language in the agreement. <br />It would be "odd" ~o pay tile developer when tile developer owes the City money. <br /> <br />Councilmember Beyer stated that she did not think Mr. Noard should have to pay the <br />$16,000 up fl'ont a nd she also felt that putting that language in the development agreement <br />was unfair. <br /> <br />Finance Officer Flart explained that the full $16,000 is not delinquent; only the amounts that <br />have not been paid thnt have been billed thus far. <br /> <br />Mr. Schroeder stated that it' Staff issues a check to Mr. Noard when Mr. NoaM, according <br />to our books, is delinquent, Council would take Staff "out to the woodshed". <br /> <br />Councilmember Beyer stated that it should be taken into consideration that Mr. Noard was <br />trying to find out what the charge was. <br /> <br />Mr. Noard stated that hc will be putting in the street, at his expense, in exchange for the <br />land. <br /> <br />Mayor Gilbertson commc'.ntcd that it is the City's land. <br /> <br />Mr. Noard inquired who would be willing to pay $20,000 for the land. He added that the <br />money he owes could be throwing a "kink" in what he's trying to do now. <br /> <br />Mayor Giibertson stated that "it should be cleaned up in one shot". The City is ready to <br />work something Otll with Mr. Noard. <br /> <br />Mr. Noard stated he made. a cash offer to the City; however, the City would not accept it. <br />He agreed that this has to be resolved but felt it has nothing to do with this present project. <br /> <br />Mayor Gilbertson sta~ed that it would speed up the resolution process. <br /> <br />Mr. Notu'd stated that these payments are on the utility account and will be paid on a <br />monthly bill that comes t'rona Anoka Electric Cooperative. To bring this up to date would <br />be to pay all owed up lo tl~e present. <br /> <br />Mr. Schroeder staled that tile interest amount due could be discussed. <br /> <br />Ms. Hart sta~ed thnt N'h'. Noard approached her regarding this bill and that things are being <br />worked <br /> <br />Mr. Schroedc,' stated t}mt the City has spent some period of time retrieving the project files <br />from 1988. The Former Finance Officer worked on this and Ms. Hart is continuing to <br />work on it. There is now enough information available to discuss a solution. <br /> <br />Councilmember Beyer questioned if it's fair to discuss interest and late charges. <br /> <br />Mr. Schroectcr replied "maybe not, but we will bring it back to Council to decide". <br /> <br />Ms. Hart slated there are no late charges and the interest is whatever other properties paid, <br />amortized over I I years. <br /> <br />Mr. Schroeder reiterated that this issue would be brought back to Council. <br /> <br />Council/July 26, 1994 <br /> Page 23 of 27 <br /> <br /> <br />
