Absent: Councilmember Beyer. <br /> <br />The public hearing adjourned at 7:18 p.m. <br /> <br />Council Business <br /> <br />Mayor Gilbertson called the regular portion of the City Council meeting back to order at <br />7:18 p.m. <br /> <br />Motion by Councilmember Peterson and seconded by Mayor Gilbertson to introduce the <br />proposed ordinance amendment to Chapter 5 of the City Code, Adding Section 5.13.07 to <br />be known as the Recycling Rates and Charges Section of the City Code, pending review by <br />the City Attorney. <br /> <br />Motion carded. Voting Yes: Mayor Gilbertson, Councilmembers Peterson and Hardin. <br />Voting No: Councilmember Zimmerman (He stated he is not comfortable with AEC doing <br />the billing; the City is losing too much control). Absent: Councilmember Beyer. <br /> <br />Case #2: Adopt Proposed Charter Amendment Ordinance <br /> <br />Mayor Gilbertson adjourned the regular portion of the City Council meeting at 7:20 p.m. in <br />order to conduct the public hearing. <br /> <br />Public Hearine <br /> <br />Mayor Gilbertson called the public hearing to order at 7:20 p.m. <br /> <br />Presentation <br /> <br />City Attorney Goodrich stated that on July 26, 1994, City Council introduced an <br />ordinance, proposed by the Charter Commission, repealing Section 4.2.1 of the Ramsey <br />City Charter. The section to be repealed reads as follows: "Any applicant currently <br />holding an elected office in the city, and seeking election to an office different from the <br />office he/she currently holds and subject to the limitations prescribed in section 2.4., shall <br />be required to submit his/her resignation from his/her current office upon filing his/her <br />affidavit. The affidavit, resignation and fees shall be submitted to the clerk-administrator <br />no earlier than fifty-six days nor later than forty-two days before any municipal election. <br />The applicant's resignation from office shall become effective after certification of the <br />election results". It was determined that this section, if challenged, would be declared <br />unconstitutional. Mr. Goodrich explained that the ordinance has been published twice as <br />per the City Charter, and if Council adopts this ordinance, it will become effective 90 days <br />from publication. <br /> <br />City Council/August 9, 1994 <br /> Page 5 of 20 <br /> <br /> <br />
