It's been said that the
City will get something done, it will get done. He added that Mr. Hendriksen had done
nothing about this for the last five years and now he wants an immediate solution. Staff is
doing their best to address this issue. He reminded Mr. Hendriksen that he stated he was
"happy" with the direction at the last council meeting.

Mr. Hendriksen stated that he is asking what was o~'dered to be done in two weeks, be
done in two weeks. He then inquired of Councilmember Zimmerman if it's possible to
have surveying done now.

Councilmember Zimmerman stated it should be no problem as the County has surveying
crews out right now. He suggested that a consulting company may have to be hired
because Mr. Jankowski does not have time.

Mayor Gilbertson offered to meet with Mr. Hendriksen and Mr. Jankowski to discuss this
issue further.

Mr. HendrikSen declined Mayor Gilbertson's offer and stated that Mayor Gilbertson had
threatened him; therefore, he felt the Mayor did not have his best interest at heart. He stated
he would be happy to meet with anyone else.

Councilmember Peterson offered to meet with him and Mr. Jankowski.

Councilmember Beyer stated that all Mr. Hendriksen is asking for is that an update be
placed on the agenda and to have his concerns addressed. He is not asking that the
solution/work be completed in two weeks. She stated she also finds it very difficult to
know what the action was when Council does not receive their meeting minutes for two
months after the fact. She suggested it would be helpful to get the minutes at the following
meeting.

Mr. Hendriksen stated he video-taped the previous meeting. Mayor Gilbertson made a
motion to approve Option #1 which was to clean the ditch, etc. and the motion was
seconded by Councilmember Peterson. City Attorney Goodrich asked that the motion
include language relating to eminent domain proceedings. Mr. Hendriksen stated that
would start the 90-day clock but now two more weeks has been lost.

Mr. Jankowski stated that this work can be done, but reiterated that it is certainly more
difficult to do it with vegetation present.

Councilmember Beyer stated she couldn't see any point in waiting.

Councilmember PetersOn suggested Mr. Jankowski develop a plan with a time line.

Mr. Schroeder stated that, in addition, Staff will be getting quotes from outside businesses.

Councilmember Zimmerman stated that he spoke to the recently retired County Engineer
Paul Ruud, and he suggested going through the Lower Rum River Watershed Management

City Council/August 22, 1994
