Voting Yes: Chairperson Bawden, Commissioners Hendriksen, Deemer, Holland <br />and LaDue. Voting No: None. Absent: Commissioners Terry and Thorud. <br /> <br />Motion by ~ssioner Deemer and seconded by Commissioner Holland to recommend that City <br />Council adop~Ordinance g93-. to amend the zoning district boundaries in the plat of <br />Rivenwick with the inclusion of the B- 1 district. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, Hendriksen <br />and LaDue. Voting No: None. Absent: Commissioners Terry and Thorud. <br /> <br />Mr. Bill Chapman of Rivenwick Properties stated that the fh'st time this rezoning was reviewed in <br />1991, Plannir~g ~d Zoning Commission recommended approval of it with no B-1. The council <br />chose to add ~ the B-1 when they reviewed it. <br /> <br />Commissioneir Deemer advised Mr. Chapman that the City Council has the power to make that <br />change. <br /> <br />Case #2: <br /> <br />Request for Preliminary Plat Approval of River's Bend 3rd Addition; <br />case of Elizabeth Raudio and Rick Foster <br /> <br />Following the ~Public Hearing concerning this matter City Engineer Jankowski met with concerned <br />residents in the foyer. <br /> ; <br />City Engineee Jankowski stated that the City is concerned with the two access points at 143rd <br />Avenue N.W~ and 144th Avenue N.W because of safety standards. He stated the developer <br />suggested tha~ the 143rd Avenue N.W. access point be contingent upon the reworking of Highway <br />#47 so that a gale sight distance exists for access. Mr. Jankowski stated that a second concern the <br />area residents [have is that there are no storm sewers in the area of Lot 22 and a third concern was <br />with the elevation of houses on Lots 23 and 24 in relationship to existing neighboring houses. He <br />stated the resi~.ents' final concern was about having housing built of similar value to theirs. Mr. <br />Jankowski ad¥ised that the City can only enforce the ordinances it has in place and at the present <br />time the City does not have any ordinances that would restrict value of houses placed on lots. <br /> <br />Mr. Jankowsl~i stated that in addition to the 143rd Avenue N.W. issue, the right-of-way for the <br />north-south street is proposed as a 60-ft. wide street. He expressed concern that the street will be <br />servicing substantial traffic generators and a sidewalk should be installed on at least one side of the <br />street, so the 12ity would be looking at a minimum 70 foot right-of-way. City Ordinance requires <br />66 or 80 feet and Mr. Jankowski stated his preference would be 80 feet of right-of-way. <br /> <br />Mr. Jankowski expressed concern about the depressed areas on Lots 16 and 17 which were four <br />feet lower thafi the road. He explained that if the inlet became plugged with melting snow, there <br />would be a potential to flood walk-out lots. He would prefer there be positive draining down to <br />the curb and st~ggested going with a split entry on those lots allowing them to be level with the <br />roadway. ~ <br /> <br />Mr. Raudio inquired if the City would pay for the sidewalk. <br /> <br />Mr. Jankowski~ stated the City would consider it with MSA funds. <br /> <br />Planning & Zoning Commission/2/2/93 <br /> Page 4 of 5 <br /> <br /> <br />
