I
I
I
I
'1
I
I
I
I
I
I
I
I
I
I
i
i
I
I

Case #2: Request for Preliminary Plat Approval of Amber Ridge; ease of
Creekview Crossing Partnership

Zoning Administrator Frolik stated Creekview Crossing Partnership is requesting preliminary plat
approval of Aanber Ridge which consists of approximately 61 acres proposed to be developed with
approximately, 123 single family urban residential lots.

City Engine~ Jankowski stated that several of the lots were deficient of the minimum 10,800
square foot ~ea and that 11 lots do not have 10,800 square feet above the wetland.

Tony Emmerlch, representing Creekview Crossing Partnership, stated that they would not request
a variance to~ot size, but they would need a variance from the City's policy of 10,800 square feet
above the wet[land.

Mr. Jankowski stated there would be 11 lots that would need a variance to the City's policy
regarding the wetland.

Mr. Emmerich mentioned that the 11 lots averaged 15,000 square feet of area each. He added that
some people like to leave their back yards go to nature.

Commissioner Deemer inquired whether any storm sewers ran into these wetlands.

Mr. Jankowski explained that the area north of 149th Avenue N.W. drains into a series of three
wetlands, with overflow from those wetlands draining out to a storm sewer down 149th and into
the Rum River. He added that the area south of 149th Avenue drains either to a sedimentation
serge pond anll over to a wetland in River's Bend 3rd Addition with an outlet to the Rum River, or
there are a coBple of catch basins which flow into a backyard-type of holding pond and then out
into the stormltsewer on 149th and out to the Rum River.

Mr. Emmerich stated they are willing to work with anything reasonable regarding the engineering
matters.

Commissioner Hendriksen stated he was not familiar with the wetland policy and inquired about
the importanc~ of that issue.

Mr. Jankowsld advised that the wetlands are not protected by the Department of Natural Resources
but that they ire protected by the Wetland Conservation Act of 1992 which says they cannot be
destroyed. H{} stated they would only be using them for drainage and not destroying them.

Chairperson Bawden polled the Commission regarding the importance of the wetland issue.
Commissioners Holland, LaDue and Thorud didn't think the wetlands were that severe.
Commissionelrs Deemer, Hendriksen and Terry would like to see lot areas closer to 10,800 square
feet above the[ wetlands.

Mr. Jankowski stated the only way the developer could get closer to 10,800 would be to
dramatically redesign the northwest quarter of the plat.

Commissionei' Hendriksen inquired as to how flexible the Commission has been in recent history,
and Ms. Frolilk stated the City has adhered fairly tight to the 10,800 policy.

Commissioner Deemer stated he didn't think he has ever seen standing water in this area.

Planning & Zoning Commission/3/2/93
