In the letter, <br />AMSCO responds to each item of the review letter. After reading the letter presented by AMSCO, <br />it appeared that there were only three items for discussion; # 5, site access; # 6, the design of <br />driveway, off-street parking, loading facilities and their hard surfacing; and # 7, utilities. Mr. <br />Harp expressed concerns as to the ability of the City to require someone to sign a petition or be in <br />favor of a petition as required by items 5 and 7 in the review letter. Mr. Harp was also concerned <br />with the City, requiring him to pave and curb the entire parking and driveway area as Azurite Street <br />N.W. has not been improved or paved to public standards, which could cause some readjustments <br />of the road elevation and additional cost to realign the driveway and curbing for the City street. <br />Mr. Harp did agree to hard-surface and curb around the parking area along the building; however, <br />he did not feel it was necessary to pave the driveway and loading areas at this time because of <br />possible future expansions and because Azurite Street N.W. is a dirt street. <br /> <br />Mr. Gromberg informed the EDC that the City does allow for financial guarantee to be pledged to <br />complete the improvements within a period of one year. <br /> <br />Commissioner Kent inquired if the City had any programs available to help alleviate the cost of <br />such financial guarantee. <br /> <br />Mr. Gromberg replied the City does not currently have any such programs. However, with the <br />future funding of the Revolving Loan Fund or the Economic Development Authority, the City may <br />be able to develop some type of program to provide financial guarantees in the future. <br /> <br />Commissioner Fults indicated that bonds and letters of credit are not that expensive for a business, <br />however, they do affect the amount of capital or line of credit that may be available from a bank or <br />lending institution. This could cause hardships for a business in its formative years. <br /> <br />Mr. Harp did indicate that it would be a hardship to arrange for a financial guarantee for the future <br />paving and curbing of the area proposed. <br /> <br />Motion by Commissioner Gorecki and seconded by Commissioner Nelson to not require the <br />owner to participate in petitions for public improvement projects in the future. The improvements <br />and their value to the property owners should stand on their own and business owners should not <br />be required ~to waive any of their rights to petition in opposition of an improvement project bY <br />applying or receiving approval of a site plan. <br /> <br />Motion carried. Voting Yes: Chairman Wagner, Commissioners Fults, Gorecki, Kent, Nelson, <br />Schroeder, Ullen and Vevea. Voting No: None. Absent: Commissioner Greenberg. <br /> <br />Motion by Commissioner Kent and seconded by Commissioner Nelson to place a case on the <br />February EDC agenda addressing the intent of the requirement of business owners that apply for <br />site plans to participate in petitions for possible future City improvement projects. <br /> <br />Motion carried. Voting Yes: Chairman Wagner, Commissioners Fults, Gorecki, Kent, Nelson, <br />Schroeder, Ullen and Vevea. Voting No: None. Absent: Commissioner Greenberg. <br /> <br />Motion by Commissioner Schroeder and seconded by Commissioner Nelson to recommend a two <br />year financial guarantee to be made available to the City for the paving and curbing of the <br />driveway, parking and loading areas at the time that Azurite Street N.W. is improved. <br /> <br />Further discussion.
