Chairperson Nixt opened the public he ,a~ing at 8:10 p.m. <br /> <br />Public Hearing-. <br /> <br />Chairperson Nixt indicated they have density transitioning requirements and tree preservation <br />requirements, and he has heard the two are not compatible. He asked if the Commission were to <br />approve this tonight if those issues have been taken into consideration. <br /> <br />Associate Planner Wald stated Staff is fully aware they would need to go back to RI, R2 and R3 <br />Districts to adjust the equation for how many trees are needed on the property. <br /> <br />Chairperson Nixt indicated tree quality versus quantity has been discussed, and asked if Staff has <br />the forestry, skills needed to enforce those requirements. <br /> <br />An EPTF spokesperson indicated they are properly staffed. <br /> <br />Associate Planner Wald added they have a member of Staff who went to forestry school, and <br />Staff has been educated on how to do the equation. <br /> <br />Chairperson Nixt stated this is changing the screening requirements, and asked if Staff is okay <br />with that change. <br /> <br />Associate Planner Wald indicated they agreed. <br /> <br />Chairperson Nixt indicated he is impressed with the work done by the EPTF. <br /> <br />Commissioner Johnson asked if he was correct in believing the city did not now have a tree <br />preservation ordinance. <br /> <br />Associate Planner Wald indicated that was correct. <br /> <br /> 'i <br />Commissioner Johnson asked if.a plan W°~ld need to be Submitted prior to land alteration. <br /> <br />The EPTF spokesperson indicated this only applies to development, not individual land owners. <br />He noted at the point the land is turned over to an individual owner the ordinance no longer <br />applies. <br /> <br />Commissioner Johnson stated that if read literally, this does not say individual landowners are <br />exempt. <br /> <br />Chairperson Nixt indicated that could be corrected by changing 9.24.04, Subd. 1. to.say 'Prior to <br />any development, land clearing, filling, or any other land alteration described in Subd. 2, a tree <br />preservation plan shall be submitted to and approved by the City'. <br /> <br />Planning Commission/July 10, 2003 <br /> Page 8 of 22 <br /> <br />-253- <br /> <br /> <br />
