I <br />I <br />I <br /> <br />I <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />! <br />I <br /> <br />instead and after the paving project is completed, providing a counter to see if traffic levels <br />are excessive. <br /> <br />Mayor C. rilbertson closed the regular portion of the meeting at 7:15 p.m. in order to conduct <br />the following public hearing: <br /> <br />1) <br /> <br />Grading and Paving Improvement of Bison Street N.W.; Improvement Projects <br />#92-20 and #92-23 <br /> <br />Mayor Gilbertson called the regular meeting back to order at 7:46 p.m. <br /> <br />City Engineer Jankowski stated that now that the public hearing is closed, Council should <br />recommend final changes to the feasibility report. The report will be sent out to the affected <br />propertY owners and then they can petition for or against the project. If more than 50% of <br />the property owners are opposed, Council cannot go forward with the project. If there is <br />no petition against the project, Council will make the decision to go ahead with the project <br />or not. <br /> <br />Chris Hampton, 17080 Bison Street N.W., Ramsey - stated he was denied due process of <br />the law by not being properly notified of this public hearing. He stated if Council goes <br />ahead with this project against the wishes of the property owners, he would hold the right <br />to start the proceedings over again. <br /> <br />Motion by Councilmember Peterson and seconded by Mayor Gilbertson to propose that <br />Bison Street N.W., south of 171st Avenue N.W. ends as a cul-de-sac. The right-of-way <br />for a through street will be purchased as a part of Improvement Project ~)2-23 but will not <br />be installed until the present landowners terminate residency. <br /> <br />Motion failed. Voting Yes: Mayor Gilbertson and Councilmember Peterson. Voting No: <br />Councilmembers Beyer, Hardin and Zimmerman. <br /> <br />Motion by Councilmember Peterson to include in the cost of the project, the parcels of the <br />land and escrow the cost of the paving. <br /> <br />Motion died for lack of a second. <br /> <br />Mr. Jankowski stated that the cost of land acquisition is factored into the latest feasibility <br />report. Construction costs are approximately $6,000. <br /> <br />John Anderley, 16917 Bison Street N.W., Ramsey - stated he is still willing to enter into <br />an agreement with the City that stipulates the easement be granted at a cost fair and <br />equitable. He stated "we're willing to bend over backwards to get this done". It doesn't <br />make sense to tie up money for 20 years. <br /> <br />Motion by Councilmember Hardin to proceed with these two projects and direct Staff to <br />work with the two property owners to acquire the right-of-way and keep 171 st closed until <br />the right-of-way is connected and the two cul-de-sacs are connected. <br /> <br />Motion died for lack of a second. <br /> <br />Councilmember Zimmerman inquired if the northern project would happen to which Mr. <br />Jankowski replied they are in their 60-day waiting period. <br /> <br />City Council/March 9, 1993 <br /> Page 4 of 7 <br /> <br /> <br />
