I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Case g2,: Request for Final Plat Approval of Amber Ridge; Case of <br /> Gary Gorham and Tony Emmerich <br /> <br />Zoning Administrator Frolik stated that Mr. Gary Gorham and Mr. Tony Emmerich are <br />requesting final plat approval of Amber Ridge. The proposed plat consists of <br />approximately 61 acres located on the east side of T.H. g47, adjacent to River's Bend. The <br />property is proposed to be developed with approximately 123 single family urban <br />residential lots. She explained there are also some lots that back up to non-protected <br />wetlands that do not meet the City's policy of containing 10,800 square feet above the <br />wetland. The City Council waived the 10,800 square feet of area above the wetland policy <br />because the wetlands are periodically dry and have upland vegetation on them. Acquisition <br />of Ouflot A in Rivers Bend is necessary for Lots 7 and 8 of Block 4 to meet minimum area <br />requirements and continuance of the trail corridor. All the lots in the plat would have <br />access from interior streets. Extension of trunk sewer is necessary to service lots in the <br />northwest comer of the plat. The Developer has agreed to extend the trunk sewer and will <br />be given credit for the cost of same against the amount of trunk sewer and water charges <br />due on the plat. The drainage and grading plan has been forwarded to the Lower Rum <br />River Water Management Organization for review and permitting. If they determine that <br />additional~drainage easements are needed, the developer will be responsible for providing <br />those easements in separate, reeordable documents. Park dedication will consist of <br />constructing eight foot wide pedestrian walkways running north and south through the plat <br />to connect with existing park areas in the district. A majority of the walkway would be <br />adjacent to, Highway//47 and the developer will be constructing a six foot landscaped berm <br />to buffer the walkway and residential uses from Highway//47. The developer will receive <br />park dedication credit for all eligible trail property in accordance with City Code and the <br />value of-the constructed improvements. Ms. Frolik stated that the proposal for Amber <br />Ridge has progressed thus far on the understanding that the installation of the <br />improvements would be privately financed with no City participation. City Code <br />establishes the methods by which the developer must provide financial guarantees for the <br />various elements of a subdivision development for both private and public projects. In <br />private projects, the f'mancial guarantee requirements for Stage I is that the developer place, s <br />a financial guarantee with the City in an amount equal to 125% of the City Engineer s <br />estimated cost for the improvements. This guarantee must be in the form of cash or a letter <br />of credit~ The developers of Amber Ridge have expressed concern that the financial <br />guarantee requirement is unreasonably excessive to the point of making a project <br />prohibitive. <br /> <br />Motion by Councilmember Peterson and seconded by Mayor Gilbertson to adopt <br />Resolution g93-04-059 granting final plat approval to Amber Ridge contingent upon <br />compliance with City Staff review letter dated April 21, 1993, resolution of necessary <br />financial guarantees and the developer entering into a development agreement with the City. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Peterson and <br />Zimmerman. Voting No: None. Abstain: Councilmember Hardin. Absent: <br />Councilmeinber Beyer. <br /> <br />Motion by Councilmember Hardin and seconded by Mayor Gilbertson to refer the issue of <br />Stage I sm.ety amounts in the case of private developments as it relates to recent changes in <br />banking laws. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Hardin, Peterson and <br />Zimmerman. Voting No: None.
