City Administrator Sehroeder <br />stated thai ~taff has been working on this project for about a year. Councilmember Beyer <br />inquired Wllere'the comment that Highway #10 is uninspiring came from. Mr. Boos stated <br />that it wa~ his opinion that Highway #10 could use some beautification. Councilmember <br />Zimmermala cautioned that Staff should exercise care when saying our City is uninspiring. <br /> <br />Motion carried. Voting Yes: Mayor Gilberts#n, Councilmembers Hardin, Beyer, Peterson <br />and Zimrflerman. Voting No: None. <br /> <br />Motion by Councilmember Hardin and seconded by Mayor Gilbertson to authorize that the <br />approximately $1,000 in material costs be funded from park supplies pursuant to the items <br />in the case. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case #$: Introduce Ordinance Conveying Title to Lots 1 through 3, <br /> Block 5, Amber Ridge to Gor-Em, LLC <br /> <br />City Attorney Goodrich stated that the City acquired Outlot A, River's Bend, as tax <br />forfeited ~operty. The City then exchanged this Outlot for trail property from the Amber <br />Ridge De¥~lopers. The City continues to hold title to Outlot A, but now it is known as <br />Lots 1 through 3, Block 5, Amber Ridge. The City needs to give a deed to the developer <br />for these 10ts. Mr. Goodrich submitted an ordinance allowing the City to convey the <br />Amber Ridge lots. He also explained that because the City acquired Outlot A through tax <br />forfeiture,~tlfle is not good and marketable unless the City obtains a deed from the previous <br />owner, or'~We complete a quite title action in District court. Obtaining the deed from the <br />previous owner is the least expensive route to follow. He stated he is hoping to obtain the <br />deed in this. way, ,.and if he is not able to he will advise the Council and seek authorization <br />to commeaoe a qmte title action. <br /> <br />Motion by~Councilmember Beyer and seconded by Councilmember Zimmerman to <br />introduce the ordinance conveying title to Lots 1 through 3, Block 5, Amber Ridge to Gor- <br />Em, LLC. <br /> <br />Motion c~ed. Voting No: None. <br /> <br />Case #6:' Change Order No. I and Final Payment to Bonine Excavating, <br /> Inc. for Improvement Project #92-19, 149th Lane N.W. <br /> Sewer, Water and Street Improvements <br /> <br />City Engineer Jankowski stated that Improvement Project #92-19 was constructed last <br />summer a~d the final punch list items were completed this fall. He stated the contractor is <br />entitled to, Compensation for additional work done.
