Case #4:

Staff Update

Economic Development Coordinator Sullivan presented an update on the Perkins/Brown
property. He stated the wood shell building is being demolished.

Economic Development Coordinator Sullivan reported a plan for a Law Firm/North Satellite
would be presented at the December meeting.

Economic Development Coordinator Sullivan stated Council made a counter offer to ACE Solid
Waste. He stated he is waiting for a response from ACE.

Member Elvig commented the counter-offer occurred because enough Council member votes
were not available. He stated the only thing that was agreed upon was presenting the counter-
offer and that there is no harm in it. He stated Council did not want to vote on this without all
members present.

Chairperson Riley asked if the debate included the role ofthe EDA.

Member Elvig replied he did not believe so. He commented that cost was the focus of the
discussion.

Economic Development Coordinator Sullivan stated the EDA's recommendation was conveyed
to Council. He stated he talked to ACE with the proposal from Council.

Discussion ensued.

Economic Development Coordinator Sullivan reported Sparkle Pool came to a settlement for the
relocation number. He stated Sparkle Pool intends to vacate the property by November 15, 2007.
He stated it would be nice to keep this business in Ramsey; however, Sparkle Pool is looking at a
site outside of Ramsey.

Member Elvig asked if the extenuating circumstances were that they mix chlorine chemicals on
site and an inspection by Fire Department uncovered alanning levels of chlorine.

Economic Development Coordinator Sullivan replied that the chlorine chemicals levels and
storage methods were a Fire Department / Fire Code issue. The on-site chemicals and related
storage did not factor in to the decision to acquire this property. He stated there are issues with
storage of chlorine on site and open mixing that would make it difficult for Sparkle Pool to
continue business in Ramsey.

Chairperson Riley asked if there was a policy on retaining businesses.

Economic Development Coordinator Sullivan replied the Relocation Act requires the City move
the existing business in its existing form. He indicated this could not be done for Sparkle Pool
due to code issues.

Economic Development Authority/November 8, 2007
Page 5 of7

5
