<br />He stated he liked the idea and he thought that until they had a history he found it hard to deny <br />the application. <br /> <br />Commissioner Cleveland agreed with everyone that has come before them. There is a level of <br />expectation when people move into an area. Looking at what they are supposed to be <br />considering is how it affects the area surrounding this. She thought this limits things when Mr. <br />Grueber indicated the events would need to be approved all together or not at all. <br /> <br />Commissioner Brauer reentered the meeting at 8:40 p.m. <br /> <br />Commissioner Levine did not think they should deny this because they do not know the impact <br />this will have on the area. He thought they should have a trial run to find out what the impact <br />will be. <br /> <br />Chairperson Nixt did not feel it met the land use because it was not designed to allow a race track <br />and it was not intended to be an outdoor event area. He wondered what will stop Mr. Grueber <br />from wanting to expand the events in the future. <br /> <br />Commissioner VanScoy thought the concept of some of these events is fantastic. He thought <br />there were places for that to happen and he did not think this was the place. He did not think this <br />fit the surrounding area. He stated he would not support this. <br /> <br />Chairperson Nixt stated he was not for this based on the lack of information. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner VanScoy, to recommend that City <br />Council adopt [mdings of fact unfavorable to the applicants request relating to the request for an <br />amended Conditional Use Permit for Diamonds Sports Bar based primarily on the lack of data to <br />support the sound issue related to the motor cross events. <br /> <br />Reword Finding 9 to read "does not intend to.. . and the applicant desires to avoid the necessity of <br />obtaining individual special event permits". Finding 10 to read "...at an "LI0"." Findings 13, <br />14 and 15, will be detrimental, will impair enjoyment, will not be harmonious with intended <br />character, and will be disturbing. Finding 17 will be served by adequate facilities, Finding 18 <br />will not create excessive and Finding 19 will because of the noise fumes and dust. <br /> <br />Motion Carried. V oting Yes: Chairperson Nixt, Commissioners VanScoy, Cleveland, and <br />Trites Rolle. Voting No: Hunt, Levine. Abstain: Brauer. Absent: None. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Van Scoy, to recommend that the City <br />Council deny the request for an amendment to the Diamond's Conditional Use Permit, based on <br />the findings of fact. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Van Scoy, Cleveland, and <br />Trites Rolle. Voting No: Hunt, Levine. Abstain: Brauer.
