<br />Councilmember Jeffrey stated that he does not think acquiring the right of way in the area will be <br />cheap and wondered if any of the property owners had been notified. <br /> <br />Associate Planner DaInes stated that there have been appraisals on all three properties which <br />came back at about $85,000 per acre. <br /> <br />City Attorney Goodrich clarified that the City will chip in $60,000 and the developer will need to <br />pay the balance. <br /> <br />Councilmember Dehen asked how the City could ensure that this happens. <br /> <br />City Attorney Goodrich stated that the City will not allow the Final Plat to be recorded until the <br />Street is constructed. <br /> <br />Public Works Director Olson stated that the City could hand over a check to the developer, if <br />there is documented evidence that the costs have exceeded $60,000, so the responsibility is all on <br />the developer. <br /> <br />Interim Community Development Director Frolik asked if the City would like the right of way <br />even if this project does not move forward. <br /> <br />Mayor Gamec stated that he didn't think the City would want the right of way in that case. <br /> <br />Interim Community Development Director Frolik stated that there should be language in the <br />development agreement that after the right of way is acquired and the road is constructed, is <br />when any reimbursement from the City would happen. <br /> <br />Councilmember Jeffrey expressed concern about up front costs. <br /> <br />Associate Planner DaInes stated that the City is requiring escrow funds be paid up front and <br />noted that the developer has indicated that this project will not happen for a few years, so the <br />acquisition process will not start until the platting begins. <br /> <br />City Attorney Goodrich asked the City Council to move onto other items while he worked on a <br />language change for the motion. <br /> <br />Case #5: <br /> <br />Adopt Contract Amendment and Review Work Plan for 2008 <br />Comprehensive Plan Project <br /> <br />Interim Community Development Director Frolik stated the City entered into an agreement with <br />Bonestroo and Associates for the 2008 comprehensive plan at an amount not to exceed $83,300. <br />She noted that the City received a grant from Blue Cross/Blue Shield (BCBS) in the amount of <br />$35,000 to incorporate active living into the comprehensive plan. She stated that the original <br />contract with Bonestroo and Associates included participation in 4 educational forums, however <br />when the Open Space Technology (OST) process was used, it resulted in additional time for the <br /> <br />City Council / December 11, 2007 <br />Page 17 of25 <br />
