<br />Councilmember Olson stated that she agrees that the City needs to respond to the residents and a <br />public hearing should be held. <br /> <br />Councilmember Jeffrey stated that he is not convinced that the Council will hear anything <br />different than has already been stated at prior public hearings surrounding this property. <br /> <br />Mayor Gamec stated that the Council may not hear anything different, but he does not want to <br />give the impression that this violation was just being pushed aside. <br /> <br />Councilmember Look asked if Mayor Gamec had a personal bias regarding this situation. <br /> <br />Mayor Gamec stated that he is very upset about this situation because he expects people to <br />follow the rules set by the City. He stated that there was no attempt by Mr. Gruber to call the <br />City to find out if this event was right or wrong. <br /> <br />Councilmember Look stated that he feels all the facts needed for the Council to make a decision <br />were included in tonight's packet. <br /> <br />Councilmember.Jeffrey stated that he is not convinced the City needs to hold a public hearing. <br /> <br />Councilmember Elvig stated that he agrees, but feels the City owes it to the people to take action <br />according to our ordinances and hold a public hearing to debate the issue. <br /> <br />City Administrator Ulrich suggested that this item be pulled from the Consent Agenda and added <br />as Case #7 during the regular Council meeting for further discussion. <br /> <br />Mr. Gruber stated that he understands the City's position on what happened, but stated that he <br />has reasons that he did not feel his actions were wrong. He stated that he is already scheduled to <br />appear before the Council on March 25,2008 for 2 Special Event Permits for the Tribute to the <br />Troops and a bull-riding event. He stated that this should show that he knows the process and <br />when he should apply for permits and stated that he honestly did not think he needed a permit for <br />this event. He stated that he admits that he violated the permit when he used the P A system, but <br />noted that he used it because he felt is was a safety issue. He noted that some snowboarders had <br />collided and it was a way to communicate with the other snowboarders. He stated that for the <br />second weekend, after he spoke with City Administrator Ulrich, parents volunteered to stand in <br />position to help communication because there was no P A system. He stated that he has been part <br />of several public hearings over the last few months and listened to people bad mouth him. He <br />stated that he was ripped apart at the last Planning Commission meeting and it wasn't even his <br />application being discussed, but that of Monster Auctions. He stated that he feels if the Council <br />decides to hold a public hearing, the same thing will happen. He asked if there was any other <br />way that the City could handle this situation other than holding the public hearing. He stated that <br />he admits that the use of the P A system was a violation. He stated that if his CUP is withdrawn, <br />he will be out of business. He asked if there was a way to let the public know what the Council <br />decided his punishment was and that it won't happen again. <br /> <br />City Council Work Session I March 11, 2008 <br />Page 3 of7 <br />
