<br />Mr. Gruber stated that the only events that will have music is the tent party, which is a Special <br />Use Permit. <br /> <br />Councilmember Look stated that he would like to hear from Police Chief Way regarding <br />measurement of decibel levels. <br /> <br />Ms. Brown stated that the holding ponds and river makes the sound reverberate. <br /> <br />Police Chief Way noted that they really have not hada lot of complaints on file for this location. <br />He stated that the noise nuisance ordinance was changed for residential areas and explained the <br />LiO and L50 designations. <br /> <br />Councilmember Dehen asked how the City monitors and ml?asures the sound. <br /> <br />Police Chief Way stated that the City" has owned a decibel meter for three years and has never <br />used it. He stated that if the officers show up at the site of a complaint and can hear the noise <br />. from the property line, they make contact and tell them that it needs to be shut down or quieted <br />down. He stated that this situation is unique because it is residential abutting B2 zoning. <br /> <br />Councilmember Dehen stated that following the L i 0 rules states the noise needs to be heard for 6 <br />minutes to be considered a violation, he asked what would happen if it was loud for 4 minutes, <br />shut down for a while and turned back up again. <br /> <br />Police Chief Way stated that they would be given a ticket, because this could also apply as a <br />disorderly conduct. He reiterated that this situation is different because it is business abutting <br />residential. <br /> <br />Councilmember Elvig stated that he also appreciates the flea market and farmer's market ideas. <br />He suggested that Mr. Gruber consider a different speaker system that can be heard by the <br />attendees easily but won't travel to the neighboring areas. He stated that he feels the City needs <br />decibel readings to have something measurable. He suggested that the police department take i 0 <br />minutes to take decibel level measurements at the site to see if they are over 65 decibels. <br /> <br />Mr. Gruber stated that for his planned bull riding event, the speaker system is brought by the <br />promoter and they keep the volume' down. He stated that for the auctions, the speaker usually <br />rides around on the back of a pick-up truck and moves through the crowd. <br /> <br />Councilmember Elvig stated that he thinks there is a way to deal with that issue using wireless <br />microphones and reiterated his suggestion that Mr. Gruber look into a better quality P A system. <br /> <br />Mayor Gamec stated that it appears that there is a consensus of the Council that the flea markets <br />and farmer's markets will be no problem and if the car show awards can be given out indoors, <br />that would also not be a problem. <br /> <br />Councilmember Elvig left the Council Chambers at 8:28 p.m. <br /> <br />City Council / March 25, 2008 <br />,Page 11 of 17 <br /> <br />P33 <br />
