<br />Mayor Gamec stated that the concern seems to be with the auctions because of possible noise <br />issues. He stated that, personally, he would only consider granting this permit for a 1 year period <br />to find out if the concerns are justified. <br /> <br />Councilmember Elvig returned to the Council Chambers at 8:30 p.m. <br /> <br />Mr. Gruber stated that because this process is starting so late, two of the auctions may not <br />happen, but next year's schedule is already being planned. . He questioned whether the permit <br />could be granted and re-worded to say that if there is a violation, the permit for the auctions <br />could be pulled at the end of the year. <br /> <br />Councilmember Strommen stated that she would be willing to grant this permit for one year, if <br />the events were scaled back a bit. She stated that she feels one year is a good trial period. <br /> <br />Mr. Gruber stated that his concern with only having a one year period is that it costs $1,000 <br />every time they have to come before the Council. He stated that he spent about $2,700 on his <br />last application that was denied by the Council. <br /> <br />Councilmember Strommen suggested that the Council could consider waiving a reapplication <br />fee, ifthere were no violations. <br /> <br />Councilmember Jeffrey suggested that the City could grant the permit for a one year period, <br />review the situation after the last scheduled event in October and, if there were no violations, <br />waive the reapplication fee. <br /> <br />Motion by Councilmember Look, seconded by Councilmember Jeffrey, to approve the resolution <br />granting the request for an Interim UsePermit for Monster Auctions and Events, Inc. <br /> <br />Further Discussion: Councilmember Elvig stated that he still feels the City needs to have some <br />sort of capability to monitor the sound and would like the police department to be out there <br />taking measurements with the decibel meter, so the City has some data to make a decision. He <br />suggested that language be included in the motion that sound levels of 65 decibels or more from <br />the adjacent properties over a 10 minute period, is not acceptable. He stated that he doesn't think <br />the ordinance addresses this issue. <br /> <br />City Attorney Goodrich reminded the Council that they need to adopt the findings of fact before <br />a resolution is crafted. He stated that items 11-13 need clarification. <br /> <br />The Council discussed the findings of fact language in items 11-13. <br /> <br />Motion withdrawn by Councilmember Look, second withdrawn by Councilmember Jeffrey. <br /> <br />Motion by Councilmember Look, seconded by Councilmember Jeffrey, to adopt Resolution #08- <br />03-060 adopting Findings of Fact #0823 relating to the request for an Interim Use Permit for <br />Monster Auctions and Events, Inc., as revised. <br /> <br />City Council!
