<br />Further Discussion: Councilmember Dehen stated that Councilmember Look had asked Ms. <br />. Brown if the P A system were only used for four events, if that would be acceptable and she <br />never had a chance to reply. He stated that he would like to hear her opinion. Ms. Brown stated <br />that she has concerns about the experience level of the people putting on the events. She stated <br />that she thinks the City should consider additional noise abatement such as planting mature trees <br />or taller berms. Councilmember Elvig stated that Mr. Gruber has a tremendous amount of <br />experience in this type of activity and will be working closely with Monster Auctions. <br />Councilmember Strommen stated that she hopes that if there are issues during the one year <br />period, that the applicant will work with the City as they arise, instead of waiting the full year. <br />Councilmember Look stated that if there are problems during the events, that Ms. Brown was <br />welcome to call him. <br /> <br />Motion carried. Voting Yes: Mayor Gamec,Councilmembers Look, Jeffrey, Dehen, Elvig, <br />Olson, and Strommen. Voting No: None. <br /> <br />Assistant Community Development Director Frolik stated that from the Council's conversation, <br />she gets the impression that for item 20 of the IUP, the Council would like a decibel level <br />reading rather than property line noise. <br /> <br />Councilniember Elvig reiterated that he does not think standing at the property line is a realistic <br />way to measure a noise nuisance. <br /> <br />Police Chief Way asked if they should follow the residential measurement levels. <br /> <br />Councilmember Look stated that he feels the City should look at both measurements since this is <br />a unique situation. <br /> <br />Councilmember Dehen asked why item #20 was included. <br /> <br />Assistant Community Development Director Frolik stated that when staff met earlier in the day, <br />there was a consensus to include what the police practice is for this type of noise nuisance. <br /> <br />Police Chief Way stated that at that meeting, they also discussed changing the time to 7:00 a.m: <br />to 7:00 p.m. rather than 7:00 a.m. to 10:00 p.m. <br /> <br />Councilmember Look stated that he doesn't like the phrase that refers to "reasonably necessary" <br />noise. He stated that this would mean that using a chain saw at your home is illegal. <br /> <br />Police Chief Way stated that technically, using a chain saw or a lawn mower would be a <br />violation, however, they are accepted in our culture. He stated that, an example would be, loud <br />music at a pool party would be considered unnecessary. He stated that it is a judgment call by <br />the officers and if it is something that keeps people up at night and stops them from sleeping, it is <br />considered a violation. <br /> <br />Mr. Gruber stated that Monster Auctions is willing to apply for Special Event Permits for the <br />rodeolbull riding and threshing show events, so they can be removed from the permit. <br /> <br />City Council / March 25, 2008 <br />Page 13 of 17 <br /> <br />P35 <br />
