Voting No: None. <br />Case <br /> i <br /> ~ Introduce Ordinance to Amend Chapter 9 of the Ramsey City <br /> #4[ !Code, Sections 9.02, 9.21.23, 9.50.37, 9.50.50 and Section <br /> ~ ~ 9.50.57 <br /> <br />Zoning Aflrn~istrator Frolik stated she presented this proposed ordinance for consideration <br />followili~am~ndments to different sections. Council tabled it for further review. She met <br />with C6~nci!member Hardin, discussed his concerns and fine-tuned the proposed <br />ordinance. <br /> 'r <br />Councilt'qemt~er Hardin asked that Section 9.21.23 B-3 Highway Business District, Subd. <br />2, Item ~'!r" ~ amended to not include self service car washes. He also suggested that <br />Subdivision $, item "b" and also item #15 of Subd. 4 be deleted to eliminate outdoor <br />storage. ! <br /> <br />Council.~ m ~.~er Peterson stated that people can request conditional use permits but Council <br />has the fiSht ~o deny them. <br /> <br />Councilg~em[~er Hardin stated he preferred to deal with outside storage in the B-3 District <br />on a ca~elby ~ase basis with a conditional use permit, if necessary, instead of allowing all <br />busines~ t0ihave it. <br />Motion b~ Cguncilmember Hardin and seconded by Councilmember Peterson to introduce <br />OrdinaliOg g92-XX amending Chapter 9, Sections 9.02, 9.21.23, 9.50.37, 9.50.50 and <br />9.50.57 a~d tO include changes made tonight. <br />Further;~sctission: Councilmember Zimmerman stated he still believes the City has to <br />include, t~e !~ight-of-way in the lot size. Ms. Frolik stated that City Code allows the <br />develoi~ to !nclude the right-of-way when platting the lots but for Code enforcement, the <br />right-o-f',v~aY!s not taken into consideration. Councilmember Beyer stated the City should <br />be cons~i~ten~ and include right-of-way when computing a lot size for Code enforcement <br />purpos~ lYIng. Schroeder stated that if the lot of record shows the parcel to be 2.3 acres, is <br />an acceti~orylstructure then allowable because the property owner thought he purchased a <br />2.5 acr~ Iht? i Councilmember Hardin suggested dealing with this lot size discussion at a <br />January~ ~ee~ng. Ms. Frolik stated that if Council adopts this, it will prohibit developers <br />from in¢l! adittg the road right-of-way for meeting lot areas. Councilmember Hardin stated <br />that mak~ :s s~nse. Ms. Frohk stated that the problem she s run ~nto ~s that all the plats ~n <br />the rural trea~ are deficient of 2.5 because the developer was permitted to include the road <br />right-of,~ ?aY~nd those buyers who thought they had 2.5 acres do not qualify for a metal <br />accessor~ str0cture.
