<br />Mr. Burrell indicated there is a drainage swale in the backyard that expands one hundred feet out <br />from the back of his home and floods. He also noted that if the new structure were moved <br />further back they would need to take more trees out for it. <br /> <br />Motion by Commissioner. Van Scoy, seconded by Commissioner Hunt, to close the public <br />hearing. <br /> <br />Motion Carried. Voting Yes: Vice Chairperson Levine, Commissioners VanScoy, Hunt, <br />Brauer, Cleveland, and Rogers. Voting No: None. Absent: Nixt. <br /> <br />The public hearing closed at 7:27 p.m. <br /> <br />Commission Business <br /> <br />Vice Chairperson Levine called the regular meeting of the Planning Commission back to order at <br />7:27 p.m. <br /> <br />Commissioner VanScoy stated he was concerned about the amount of overage they are looking <br />at. He stated he does have a problem with the size. <br /> <br />Commissioner Cleveland stated she was having a problem with the size as well. <br /> <br />Motion by Commissioner Brauer, seconded by Commissioner Hunt, to recommend that City <br />Council adopt Findings of Fact relating to the applicants' request for a conditional use permit to <br />exceed the amount of accessory structure space allowed on the subject property. <br /> <br />Motion Carried. V oting Yes: Vice Chairperson Levine, Commissioners Brauer, Hunt, and <br />Rogers. Voting No: Cleveland, VanScoy. Absent: Nixt. <br /> <br />Commissioner Brauer stated he did not see anything in the Findings of Fact that raises a red flag <br />indicating they should not do this. He felt the applicant should be able to keep the existing <br />building. <br /> <br />Motion by Commissioner Brauer, seconded by Commissioner Hunt, to recommend that City <br />Council approve the applicant's request for a conditional use permit to exceed the amount of <br />accessory structure space allowed on the property, declaring terms of same and in item 2, <br />increasing the maximum allowed to 2,770 and delete the last sentence. <br /> <br />Motion Carried. Voting Yes: Vice Chairperson Levine, Commissioners Brauer, Hunt, and <br />Rogers. Voting No: Cleveland, Van Scoy.
