Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #00-10- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT TO <br />MAINTAIN A SECOND DWELLING ON A P,~d:~CEL. <br /> <br /> WHEREAS, Loving Care Senior serVices, Inc. has properly applied for a conditional use <br />permit to maintain a second dwelling on the property generally known as 8201 163~d Avenue <br />N.W. and legally described as follows: <br /> <br />Lot 9, Block 4, Oakridge Estates, Anoka County, Minnesota: <br />("Subject Property"). <br /> <br /> WHEREAS, the Planning Commission met on October 3, 2000, conducted the public <br />hearing and recommended City Council approval of the request. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact # , a conditional use permit ("Permit") to maintain a second <br />dwelling on the Subject Property is hereby granted to Loving Care Senior Services, Inc. <br />("Permittee"). <br /> <br />The second dwelling shall not be discontinued as an accessory use to the principal dwelling <br />by way of sale or lease unless the property is subdivided in accordance with relevant City <br />Codes. <br /> <br />3. The Building Official will conduct the appropriate inspections of the second dwelling to <br /> insure the structure meets Uniform Building Code requirements, prior to occupancy. <br /> <br />The Building Official will obnduct an inspection of the underground tunnel connecting the <br />two dwellings, prior to occupancy of the second dwelling. <br /> <br />5. The Permittee shall obtain a Certificate of Occupancy for the second main dwelling on the <br /> Subject Property. <br /> <br />The Conditional Use Permit upon written notice being provided by the City to the Permitee <br />but without further action by the Planning Commission or City Council, shall expire if the <br />permit holder fails to initiate such conditional use permit and fulfill each and every condition <br />attached thereto within one (1) year from the date of its authorization, or if the use is <br />discontinued fbr a continuous twelve (12) month period, unless a petition for an extension of <br />time in which to complete or utilize the use that has been granted by the Council. Such <br />extension shall be requested in writing and flied with the City at least thirty (30) days before <br /> <br />-127- <br /> <br /> <br />
