I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />i <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />City Engineer Jankowski stated when Azurite Street was platted there was irregularity to the <br />fight-of-way. <br /> <br />Mayor Gamec stated his recollection was that the roadway was centered on the existing <br />easement. <br /> <br />City Attomey Goodrich noted the findings of fact must be adopted and the conclusion must <br />correspond with the findings of fact. He noted the findings of fact were recommended by the <br />Planning Commission who recommended denial so they are in the negative. If the Council <br />decides to consider approval, they would have to adopt findings of fact in the positive. He stated <br />he finds very few facts contained within the Planning Commission public hearing meeting <br />minutes that relate to the adopted findings of fact. <br /> <br />City Administrator Norman read finding of fact #11 related to impact of traffic in the area. <br /> <br />Councilmember Connolly noted these findings of fact relate only to the transfer station and asked <br />about the number of trucks involved in the transfer station. <br /> <br />Councilmember Hendriksen stated the question may be if the number of trucks generated from <br />this site are reasonable when compared to the asphalt site. <br /> <br />Council consensus was reached for the following findings of fact: <br /> <br />11. That the proposed use will not adversely impact traffic in the area. <br /> <br />12. <br /> <br />That the proposed use will not be dangerous or detrimental to persons residing or <br />working in the vicinity of the use or to the public welfare <br /> <br />It was noted that the applicant has presented a market value study indicating no adverse impact to <br />property values surrounding the Brooklyn Park site. <br /> <br />Council consensus was reached to accept the following finding of fact based on staff and public <br />input received tonight: <br /> <br />13. <br /> <br />That the proposed use will not adversely impair the use, enjoyment or market value of <br />surrounding properties. <br /> <br />City Attorney Goodrich noted that pictures of surrounding properties have been submitted for <br />viewing and can be compared. <br /> <br />Councilmember Hendriksen suggested finding of fact #14 be amended to indicate: "such use will <br />not adversely effect the essential character of the area." <br /> <br />City Council/April 25, 2000 <br />Page 15 of 29 <br />-113- <br /> <br /> <br />
