He stated he felt it was fair that adjacent residents should not
have their evenings interrupted by noise and reiterated his concern regarding stockpiling
materials.

Commissioner Brauer asked if it would be feasible to break the wood down into six or eight foot
lengths prior to bringing the logs on site in order to cut down on the noise.

Chairperson Nixt suggested giving consideration to placing specific time limits on the loading
and unloading activities.

Motion by Chairperson Nixt, seconded by Commissioner Levine, to recommend that City
Council adopt Findings of Fact relating to the applicant's request for a home occupation permit.

Motion carried. V oting Yes: Chairperson Nixt, Commissioners Levine, Brauer, Hunt, and Van
Scoy. Voting No: None. Absent: Commissioners Cleveland and Rogers.

Motion by Chairperson Nixt, seconded by Commissioner Brauer, to recommend that City
Council approve the applicant's request for a home occupation permit based.on the findings of
fact, subject to City staff working with the applicant to put in place time constraints with respect
to the hours of operation relative to splitting, chipping, shredding, or otherwise subdividing wood
on the property.

Further Discussion: Commissioner Brauer asked if there also needs to be a requirement for some
type of screening.

Chairperson Nixt asked if the Planning Commission needs to designate a location for storage and
to require proper screening, and whether it should look at some basis for establishing a maximum
height of accumulated materials and putting an aggregate limitation on what can be on site at any
given time.

Associate Planner Gladhill stated that Case #3 will address these issues.

Planning CommissionlNovember 6, 2008
