Ms. Frolik stated that some of the Riverside West residents present at the public hearing, expressed <br />concern with regard to City utilities. <br /> <br />Mr. Doug Fountain, 15255 Garnet Street N.W., Ramsey - inquired how Faye Construction <br />proposes to control a private recreational facility in Outlot F and a public recreational facility in <br />Outlot E. <br /> <br />Mr. Chapman replied that an agreement would have to be worked out and possibly fencing would <br />be the answer. Mr. Chapman stated he is recommending approval of the rezoning to be contingent <br />on the final plat as filed. <br /> <br />City Engineer Jankowski stated that out of 17 items listed in his review letter, the 10 which remain <br />unresolved should be resolved at the final plat stage. He added that because the park plan has been <br />modified, it should once again return to the Park and Recreation Commission for review. He <br />commented that substantial park area has been reserved for a drainage easement and any area of a <br />park used for drainage cannot be counted as parkland for dedication purposes. <br /> <br />Ms. Frolik stated that if the preliminary plat is approved, it is appropriate to introduce the ordinance <br />to amend rezoning boundaries to coincide with the preliminary plat at this time and delay adoption <br />of the ordinance until the final plat is recorded. <br /> <br />Mr. Goodrich noted that if the final rezoning description varies from the legal description in the <br />hearing notice, the City will have to hold another public hearing. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beyer to approve the <br />preliminary plat of Faye 2nd Addition contingent upon compliance with the City Engineer's review <br />letter dated February 28, 1991 and favorable reviews from all reviewing agencies and the City of <br />Ramsey Park and Recreation Commission. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Peterson, Beyer and Hardin. <br />Voting No: None. Absent: Councilmember Cich. <br /> <br />Case #3: <br /> <br />Request to Amend the Business and <br />boundaries in the Proposed Plat of Faye <br />Construction <br /> <br />Residential District Zoning <br />2nd Addition; Case of Faye <br /> <br />Ms. Frolik stated that Faye 2nd Addition is proposed to be developed with commercial activity <br />adjacent to Highway #10 and single family residential development south to the Mississippi River. <br />However, Faye Construction has requested a rezoning to realign the district boundary between the <br />commercial and residential portions of the property to coincide with the preliminary plat submitted <br />for approval. Ms. Frolik suggested City Council review the proposed findings of fact and noted <br />that #3, 2nd paragraph should read B-3/B-2 instead of just B-3. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beyer to adopt Resolution <br />4/91-04-085 adopting Findings of Fact//0294, as corrected, relating to Faye Constmction's request <br />for a rezoning of the business and residential areas in the proposed plat of Faye 2nd Addition. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Peterson, Beyer and Hardin. <br />Voting No: None.
