Absent: Councilmember Cich. <br /> <br />Case #5: Conditional Use Permit Request Aluminum Recycling, Inc. <br /> <br />Mr. Mefland Otto stated that Mr. Glen Rychner had applied for a conditional use permit to develop <br />and operate an aluminum processing plant on property zoned B-W, Business-Warehouse. The <br />request was brought before City Council on March 26, 1991 and was tabled until April 23, 1991. <br />Staff was directed to revise Planning and Zoning Commission's findings of fact, approved March <br />21, 1991, to reflect that the proposal is incompatible with the intent of the B-W district. <br /> <br />Mr. Jim Neilson, Attorney for Mr. Rychner, was present and stated that Mr. Rychner must vacate <br />his present site by May 31, 1991; therefore, he must have a decision by City Council tonight. He <br />stated that a proper findings had been done by the Planning and Zoning Commission and that the <br />City Council should adopt those. He stated the problems occurred when the zoning changed in <br />December, 1990. He added that the property is clearly industrial, not retail. Mr. Neilson <br />presented pictures taken today, April 23, 1991, of the property east of the subject site. He stated <br />that Minnesota Sawdust is a manufacturing business and the other property to the north is Northern <br />Die Casting which melts aluminum. <br /> <br />City Attorney Goodrich stated that the intention of the new findings was to basically reiterate what <br />the ordinance states and that the ordinance language is almost verbatim. <br /> <br />City Council proceeded to review the findings of fact. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Peterson to delete the present <br />#26 and add a new one to read: "This CUP, as proposed, will include two primary principal <br />structures and no accessory buildings". <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Beyer and Peterson. Voting <br />No: CouncilmemberHardin. Absent: Councilmember Cich. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beyer to delete #27. <br /> <br />Motion carried. Absent: Councilmember Cich. <br /> <br />Mr. Danny Karst, Danny's Aluminum Processing, stated he made his business comply to the City <br />Ordinances and now his competition wants to undermine these ordinances. He feels Mr. Rychner <br />should be made to design his business to comply with the ordinances and keep it a fair playing <br />field for all. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beyer to add language from <br />City Code 9.03.06 Subd. 4(a) 1 to #27. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Peterson, Beyer and Hardin. <br />Voting No: None.
