<br />City Attorney Goodrich stated that, by law, the City doesn't have to give him any time, and this <br />isfour months. <br /> <br />Ms. Ruehle stated that the one time the City took in rent was because the City took over the lease <br />agreements of the tenants. <br /> <br />Councilmember Dehen asked if the City could just say that he will have to move out. <br /> <br />Ms. Ruehle stated that this is against the Uniform Relocation Act. <br /> <br />City Attorney Goodrich asked if the City had to close on the property first. <br /> <br />Ms. Ruehle stated that she wasn't sure. She stated that her recommendation is that once the <br />properties that are already in the works are completed, the Council should layout policies, for <br />example, demolition costs should be reduced from value of the site, the rent issue may be another <br />and the amount of time allowed to relocate. <br /> <br />Mayor Gamec stated that for this property, he would like to give 90 days and anything over that <br />he should pay rent, if he has not vacated the property. <br /> <br />City Attorney Goodrich stated that he had recommended keeping $10,000 in escrow in case there <br />is eviction action needed or even for clean-up of what he leaves behind. <br /> <br />Ms. Ruehle stated that if the City did collect rent, it cannot be revenue for the City. <br /> <br />City Attorney Goodrich stated that it would be all RALF funds. <br /> <br />City Administrator Ulrich asked if an auto business requires a Conditional Use Permit. <br /> <br />Community Development Director Miller stated that it depends 'on the zoning district. <br /> <br />City Attorney Goodrich stated that he would like to find out about the possible addresses in <br />Ramsey that Mr. Wilson has indicated he would move to beforetonight's Council meeting. <br /> <br />Councilmember Elvig stated that he wasn't aware the City was having problems with him. He <br />stated that his suggestion is to charge no rent for 90 days and asked if the City can do something <br />other than rent, such as a usage fee or fine, after90 days. ' <br /> <br />Councilmember Dehen stated that perhaps the City could charge 90 days of rent and, if the place <br />is left in good condition, that could be refunded. <br /> <br />Councilmember Elvig stated that he thinks the escrow is the real key tool. <br /> <br />Ms. Ruehle stated that the time of year may also playa factor, based on weather, because of <br />possible difficulties in removing frozen cars. <br /> <br />City Council Work Session / December 9, 2008 <br />Page 3 of7 <br />
