Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #09- 01 -XXX <br />RESOLUTION TERMINATING IMPROVEMENT PROJECT #08 -31 - THE <br />BITUMINOUS PAVING OF CHAMELEON STREET IN THE SHAWN ACRES <br />SUBDIVISION <br />WHEREAS, pursuant to a motion of the Ramsey City Council on May 27, 2008 , a feasibility <br />study has been prepared by Steve Jankowski, City Engineer, Improvement Project #08 -31 - The <br />Bituminous Paving of Chameleon Street in The Shawn Acres Subdivision; and <br />WHEREAS, a resolution of City Council adopted on Octoberl4, 2008 fixed a date for a <br />Council hearing on the proposed improvement; and <br />WHEREAS, ten days' mailed notice and two weeks published notice of the hearing was given, <br />and the public hearing was held thereon on the 10th day of November, 2008., at which all persons <br />desiring to be heard were given an opportunity to be heard thereon; and, <br />WHEREAS, a petition opposing IP #08 -31 has been received which has been signed by more <br />than 50% of the benefitted property owners. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />That IP #08 -31 is hereby terminated and a similar project shall not be considered within <br />twelve months of the date of this resolution <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />and upon vote being taken thereon, the following voted in favor thereof: <br />and the following voted against the same: <br />and the following abstained: <br />and the following were absent: <br />where upon said resolution was declared duly passed and adopted by the Ramsey City Council <br />this the 13th day of January 2009. <br />ATTEST: <br />City Clerk <br />Mayor <br />RESOLUTION #09- 01 -XXX <br />Page 1 of 1 <br />
