Police Chief Auspos stated that Mr. Lalley had applied for an on-sale intoxicating liquor license; <br />however he had answered question #17 on the application, which deals with liquor law violations, <br />in the affirmative. <br /> <br />City Attorney Goodrich stated that Mr. Lalley was convicted in 1989 of selling intoxicating liquor <br />to a minor. He added that the original charge is vacated and dismissed; therefore, the conviction is <br />erased from his record. He stated there are no grounds to deny Mr. Lalley's application under the <br />City's ordinances or State Statutes and suggested that Council conduct a public hearing. <br /> <br />Motion by Councilmember Hardin and seconded by Councilmember Cich to recommend a public <br />hearing be scheduled to hear comments regarding the application for on-sale liquor license for Joel <br />Lalley, Jimmy B's American Cafe and Lounge. <br /> <br />Motion carried. Voting Yes: Councilmembers Hardin, Cich, Beyer and Peterson. Voting No: <br />None. Abstain: Mayor Gilbertson. <br /> <br />Case #3: On-Sale Non-Intoxicating Beer License for Greg Muller dba Ramsey <br /> Pizza Factory <br /> <br />Police Chief Auspos stated that Mr. Muller applied for an on-sale non-intoxicating beer license for <br />his business located at 6001 - 167th Avenue N.W. He has been in business for nine months and <br />has no liquor related violations. He stated that Mr. Muller has paid the $200 license fee as required <br />by ordinance. He added that if approval is given on October 22, 1991, there Will only be eight <br />months until renewal and he feels Mr. Muller deserves a four month rebate. <br /> <br />Motion by Councilmember Cich and seconded by Councilmember Beyer to approve the issuance <br />of an on-sale non-intoxicating beer license to Greg Muller dba Ramsey Pizza Factory. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Cich, Beyer, Hardin and <br />Peterson. Voting No: None. <br /> <br />Finance Officer Helling was directed to issue a four month rebate to Mr. Muller. <br /> <br />Case #4: <br /> <br />Receive Bids and Award Contract for Project #91-01 Highway #10 <br />Sanitary Sewer and Watermain <br /> <br />City Engineer Jankowski stated that Improvement Project g91-01 involves the construction of <br />sanitary sewer and watermain to service five properties located along the north side of Highway <br />#10 from the eastern City limits to J.R.'s Saloon. There were eight bids received and the basic bid <br />anticipated the project starting on or about November 4, 1991 and being complete within 45 <br />calendar days. An alternate bid was requested which would anticipate the project being constructed <br />during the Spring of 1992. The lowest bid and alternate bid was from Richard Knutson, Inc. <br /> <br />Motion by Councilmember Cich and seconded by Councilmember Hardin to award the alternate <br />bid to Richard Knutson, Inc. of $138,150.20 with the proviso that if rights-of-entry could be <br />obtained such that the project could proceed this fall in a manner acceptable to the contractor, then <br />they would approve the award of the base bid amount of $136,150.20 via a change order. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Cich, Hardin, Beyer and <br />Peterson. Voting No: None. <br /> <br />Case #5: Receive Bids and Award Contract for Project #91-13 Wood Pond <br /> Hills Trunk Sanitary Sewer and Watermain <br /> <br />City Engineer Jankowski stated this project involves providing trunk watermain and sewers to <br />service the Wood Pond Project subdivisions.
