Motion by Councilmember Beyer and seconded by Councilmember Peterson to direct Staff to draft <br />a recommendation on water and sewer charges and return for Budget Committee review as soon as <br />possible and to also draft an ordinance amendment allowing water and sewer rates to be amended <br />by resolution rather than by ordinance. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Beyer, Peterson, Cich and <br />Hardin. Voting No: None. <br /> <br />Case #13: <br /> <br />Consider Authorization for Retaining an Administrative Law Judge <br />Regarding Health Ordinance <br /> <br />City Administrator Schroeder stated that pursuant to City Ordinance//91-14, the City's Health <br />Authority has served an Order on the owner/operator of an Adult Use located at 6710 Highway <br />#10 in Ramsey. The owner has demanded a hearing before the City's Health Authority who <br />prefers that an independent reviewer hear the testimony and make findings of fact. Mr. Schroeder <br />stated that the State of Minnesota has a hearing office established for this purpose. The hearing <br />officers are called Adnfinistrative Law Judges ("ALJ"). He stated the hearing is tentatively set for <br />10:00 a.m., January 8, 1992 at City Hall. The ALJ will make a recommendation to City Council <br />and then City Council will enforce their recommendation. <br /> <br />Motion by Councilmember Peterson and seconded by Mayor Gilbertson to authorize the City <br />Administrator to enter into an agreement with the State of Minnesota Office of Administrative <br />Hearings for the purpose of having an Administrative Law Judge conduct a hearing pursuant to <br />Section 5.15.05 (2)(c)(2) of City Ordinance//91-14. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Peterson, Beyer, Cich and <br />Hardin. Voting No: None. <br /> <br />Case #14: 1992 Legal Services <br /> <br />City Administrator Schroeder stated that pursuant to Council direction, Staff has submitted <br />requests for proposals for general legal, prosecution and development legal services. <br /> <br />Consensus of the Council was that all the proposals received should be passed onto the Budget <br />Committee for their review and recommendation and placed on a January agenda for Council <br />action. <br /> <br />Case #1.5: Accept Resignation from Councilmember Richard Cich <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Cich to adopt Resolution <br />#91-12-274 accepting the resignation of Councilmember Richard Cich and pursuant to Section 2.5 <br />of the City Charter hereby declare as of January 14, 1992, a vacancy shall exist on the Ramsey <br />City Council. <br /> <br />Motion carried.
