<br />AGREEMENT <br /> <br />THIS AGREE.MENT, made and entered into by and between the CITY OF RAMSEY, <br />a municipal corporation of the State of Minnesota (the "CITY"), and RAMSEY LAND <br />COMPANY, LLC, a Minnesota limited liability company, (the "OWNER"). <br /> <br />WITNESSETH: <br /> <br />WHEREAS, Owner has contracted to purchase the property located at 9550 156th <br />Avenue Northwest, Ramsey, Minnesota 55303, and legally described as: <br /> <br />Lot 1, Block 1 , West Ramsey Industrial Park, Anoka <br />County, Minnesota <br /> <br />(the "Property"); <br /> <br />WHEREAS, the Property is one lot of a larger subdivision known as the West <br />Ramsey Industrial Park; <br /> <br />WHEREAS, West Ramsey Industrial Park was developed pursuant to a <br />Development Agreement dated June 4, 2002 by and between the City of Ramsey and J.R. <br />Land and Cattle Company LLC (the "Development Agreement"); <br /> <br />WHEREAS, the Development Agreement has been recorded in the Office of the <br />Anoka County Recorder on June 4, 2002, as Document No. 1680746; and <br /> <br />WHEREAS, all of the terms, conditions and requirements of the Development <br />Agreement have been complied with respect to the Property. <br /> <br />NOW, THEREFORE, the CITY and OWNER agree as follows: <br /> <br />1. CITY agrees that all of the terms, conditions and requirements of the <br />Development Agreement have been met with respect to the Property, and <br />hereby releases the Property from the Development Agreement in all <br />respects. <br /> <br />2. OWNER acknowledges that pursuant to City Codes the building on the <br />Property must be connected to the City's sanitary sewer system and <br />municipal water system within two years of the date on which both of <br />those systems are available to serve the Property. OWNER acknowledges <br />that the Property will be specially assessed for the benefit of the sanitary <br />sewer and municipal water utilities pursuant to then City special <br />assessment policy. <br /> <br />~ <br />
