The individual lot sizes resulting from the reconfiguration would be 2.5 acres, 9.7 acres and <br />35.1 acres. <br /> <br />Chairman Zimmerman asked Mr. Bauer if what he is requesting a a simple three lot minor <br />subdivision to which Mr. Bauer replied yes. Mr. Bauer added that he would like to waive the <br />blacktopping unless there is further development. <br /> <br />Ms. Frolik explained that a minor subdivision is three lots or less with no public improvements, so <br />by definition, what Mr. Bauer is proposing is a subdivision. She stated that with the lot <br />rearrangement, the City would have a chance to rectify substandard properties. <br /> <br />Mr. Jankowski stated that what Mr. Bauer is proposing is more reasonable than what is existing, <br />but it should be made clear that the proposed cul-de-sac is temporary and intended to be extended <br />in the future. Mr. Jankowski indicated that a problem is created by Mr. Bauer not blacktopping the <br />road; it is excessive maintenance for the Public Works Department. <br /> <br />Ms. Frolik added that other minor subdivisions have not gone through because the developer could <br />not afford the paving. She mentioned "uniform treatment". <br /> <br />Commissioner Deemer commented that 177th Avenue N.W. is listed as a parcel and questioned <br />whether or not it was a dedicated street. <br /> <br />Mr. Jankowski replied that it is City owned; however, it was not dedicated as right-of-way. <br /> <br />Commissioner Deemer maintained that the City will be ahead. He stated that Mr. Bauer is not <br />creating new lots, he is changing boundaries. <br /> <br />Ms. Frolik declared that buildable lots are being created. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner LaDue to recommend City <br />Council to allow Gerald Bauer's request for a minor subdivision (Echo Ridge) contingent upon <br />177th Avenue N.W. being completed with at least Class Five for its entire area from Highway #47 <br />to the end of the cul-de-sac adjoining Lot 3, Block 1, Echo Ridge Addition and if the issue of <br />upgrading the street cannot be resolved, this case must come back to the Planning and Zoning <br />Commission for discussion. <br /> <br />Further discussion: Commissioner Hendriksen inquired as to who pays for the upgrading of <br />streets. Commissioner Deemer replied that it is paid for by the property owner or developer. Mr. <br />Bauer asked why the last developer (Gobernatz) was not made to upgrade the road. Commissioner <br />Deemer stated that those minutes should be checked as he had requested that the road be upgraded <br />at that time. It was suggested that maybe Mr. Bauer could get together with Mr. Gobernatz and <br />something could be worked out. Commissioner Hendriksen asked Ms. Frolik what the past <br />practices have been. Ms. Frolik stated that the requirements are to pave all streets within the <br />boundary of the plat. Commissioner Hendriksen commented that it would be cheaper to put Class <br />5 on 317 feet of someone else's road then blacktopping that portion of the road which fails into the <br />boundaries of his own plat. He added that Commissioner Deemer's motion is concessive to Mr. <br />Bauer. Mr. Bauer replied he has no problem with building up the road and putting on Class 5. <br />Chairman Zimmerman stated he couldn't see extending the cul-de-sac at this time as that would be <br />putting constraints on the configuration of the future road. Mr. Jankowski stated the road should <br />be dedicated at least far enough into Block 1 so Lot 3 could further subdivide without cooperation <br />of the owner of Lot 2 in the future and Lot 2 could also extend the roadway to subdivide his lot. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, LaDue, Hendriksen <br />and Thorud. Voting No: None.
