Case #3: Request for a Conditional Use Permit to Maintain More than One <br /> Principal Structure on a Lot of Record; Case of Grace Community <br /> Bible Church <br /> <br />Chairman Zimmerman explained there had been a public hearing held earlier in the evening and <br />made note of the findings of fact included in the agenda. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner LaDue to amend items # 12 <br />through 19 of the findings of fact to reflect the positive determination. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, LaDue and Thorud. <br />Voting No: None· Abstain: Commissioner Hendriksen (not present for the public hearing). <br />Absent: Commissioners Bawden and Terry. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Thorud to recommend that City <br />Council adopt the Findings of Fact as amended, relating to a request from Grace Community Bible <br />Church for a conditional use permit. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, Thorud and LaDue. <br />Voting No: None. Abstain: Commissioner Hendriksen (not present for the public hearing) <br />Absent: Commissioners Bawden and Terry. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to amend #1 of the <br />conditional use permit to read... "The construction of a parsonage on the subject property shall <br />no commence until such time as a building permit has been properly applied for and issued and that <br />the soil borings will be taken in the area of the proposed structure before the permit is issued. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, Hendriksen, LaDue <br />and Thorud. Voting No: None. Abstain: Commissioner Hendriksen (not present for the public <br />hearing) Absent: Commissioners Bawden and Terry. <br /> <br />Ms. Frolik indicated a concern with the language in #2 which reads... "The parsonage shall be <br />constructed in an area of the lot so as not to prohibit future subdivision of the property in <br />accordance with City Code. She felt the condition should be written to prevent business owners <br />from acquiring the property for a business and living on the same property as their business. <br />There is enough frontage for two lots, but it may not be feasible to subdivide with both structures <br />on one side of the lot. The lot is zoned R1-R with conditional use permit for church. If there <br />would be another use of the church structure, the structures should be separated. <br /> <br />Commissioner Deemer stated that if the church ceases, the property becomes R1-R. <br /> <br />Motion by Commissioner Hendriksen and seconded by Commissioner Deemer to amend #2 to read <br />·.. "The parsonage should be constructed in an area of the lot approved by the City Engineer. <br /> <br />Motion carried· Voting Yes: Chairman Zimmerman, Commissioners Hendriksen, Deemer, LaDue <br />and Thorud. Voting No: None. Absent: Commissioners Bawden and Terry. <br /> <br />Chaim~an Zimmerman proceeded to read the conditions aloud to the audience. <br /> <br />Chairman Zimmerman asked Pastor Barrows if he had seen the proposed conditions. <br /> <br />He stated he had and felt there were reasonable. <br /> <br />Planning & Zoning Commission/March 5, 1991 <br /> Page 5 of 10 <br /> <br /> <br />
