NOTE CITY COUNCIL MEETING MINUTES <br /> <br />The Commission noted the following City Council meeting minutes: <br /> <br />1) <br />2) <br /> <br />City Council regular meeting minutes dated October 8, 1991. <br />City Council public hearing and regular meeting minutes dated October 22, 1991. <br /> <br />COMMISSION BUSINESS <br /> <br />Case #1: Request for Preliminary Plat Approval of Wood Pond Hills; Case of <br /> BLH Development Company <br /> <br />Zoning Administrator Frolik stated that BLH Development Company is requesting preliminary plat <br />approval of Wood Pond Hills which consists of approximately 72 acres proposed to be subdivided <br />into 135 lots. The Planning and Zoning Commission conducted a public hearing regarding this <br />proposed plat and tabled action on the plat until after the Park and Recreation Commission made a <br />recommendation on the trail corridor alignment and the alignment of Sunfish Lake Drive N.W. in <br />the northwest corner of the plat was resolved with the DNR. Ms. Frolik reported that on <br />November 14, 1991, the Park and Recreation Commission reviewed the plat of Wood Pond Hills <br />for trail corridor alignment and their recommendation was that the developer would receive park <br />dedication credit for only the amount of land given for trail purposes. It was also their <br />recommendation that the developer will provide for a trail alignment which has 15' of its width <br />above the ordinary high water mark which is 858.1. She stated that the developer has provided her <br />with the revised grading plan. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to recommend that City <br />Council approve the preliminary plat, as revised, for Wood Pond Hills contingent upon the trail <br />corridor being identified in accordance with the Park and Recreation Commission's <br />recommendation and Sunfish Lake Drive realigned in accordance with the City Engineer's letter <br />dated November 12, 1991 to DNR and also the county ditch should be shown because it curves <br />through the northwest comer of the plat. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, Terry, Bawden, <br />LaDue and Thorud. Voting No: None. Absent: Commissioner Hendriksen. <br /> <br />Case #2: <br /> <br />Request to Vacate a Portion of Drainage Easement Located on PIN R- <br />20-32-25-12-0004; Case of RJS Builders, Inc. <br /> <br />City Engineer Jankowski stated that the portion of the drainage easement to be vacated represents <br />approximately 50% of a drainage easement set aside to service Block 3 of The North Forty 3rd <br />Addition. The remaining 50% of the easement encompasses the northeast quarter of the adjacent <br />Lot 3. This drainage easement does not drain any public right-of-way, but it may one day drain a <br />portion of a future trail. The existence of this drainage easement serves to protect houses <br />constructed on Lots 2 and 3 from potential flooding under unusual precipitation. Mr. Jankowski <br />recommended allowing vacation of the easternmost 80 feet which will be sufficient to <br />accommodate location of the proposed dwelling. He stated the developer has submitted a grading <br />plan that calls for enlargement of the natural low area. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to recommend that City <br />Council approve the vacation of the easternmost 80 foot drainage easement on Lot 2, Block 3, The <br />North Forty 3rd Addition, contingent on indemnification for flooding on that lot for the proposed <br />structure. Further to note that by choice the property owner is creating an exceptionally deep front <br />yard and in the future the City will not consider granting a variance to place an accessory structure <br />nearer the front property line than the principal structure. <br /> <br />Planning and Zoning Commission/December 3, 1991 <br /> Page 2 of 5 <br /> <br /> <br />
