Absent: Commissioner Hendriksen. <br /> <br />Case #3: Request to Vacate Dedicated Street Right-of. Way Across Outlots C <br /> and D of Northfork Addition; Case of North Fork, Inc. <br /> <br />City Engineer Jankowski stated that North Fork, Inc. is requesting that the City of Ramsey vacate <br />certain easements that were acquired during the platting process of Northfork, P.U.D. The first <br />easement across Outlot D, connecting 153rd Avenue N.W. with Highway #10 was acquired before <br />the City had decided on the exact routing of the future connection of 153rd Avenue N..W. to <br />Highway #10. He stated that the City has now connected 153rd Avenue N.W. to Highway #10 <br />using a different alignment than the easement that was acquired. State Statute requires that it be <br />found in the public interest to vacate a public street or right-of-way. The vacation being requested <br />is based on the City no longer having a need for that particular alignment for a connection of 153rd <br />Avenue N.W. to Highway #10. As for the vacation of the right-of-way easement across Outlot C <br />connecting Andrie Street N.W. to 164th Avenue N.W. in Woodlawn Estates, the Commission will <br />need to receive additional input from the developer as to the alignment of the streets before it <br />decides whether or not to vacate this easement. <br /> <br />Mr. Dennis Peck, representing North Fork, Inc. presented the original North Fork plat. He stated <br />that when this plat was being processed, the City required agreements guaranteeing roadways <br />would be provided to the eastern boundary of the plat and to Highway #10. Outlot D has been <br />sold but there is a problem because one of the easements runs through it. The second easement <br />runs through the middle of a marsh in Outlot C and the Army Corps of Engineers will not approve <br />that alignment. North Fork Inc. is requesting they be allowed to have both the easements vacated <br />at this time and deal with the road alignment to the east boundary of the plat at a later date. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Bawden to recommend City <br />Council vacation of street easement across Outlot D of Northfork Addition. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Deemer, Bawden, LaDue, <br />Terry and Thorud. Voting No: None. Absent: Commissioner Henddksen. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Bawden to recommend to City <br />Council vacation of street easement across Outlot C of Northfork Addition. <br /> <br />Further discussion: Commissioner Deemer stated he would like to see what it conflicts with before <br />they vacate it. Mr. Peck recommended that the Planning and Zoning Commission read the terms of <br />the document under which these easements were acquired. Chairman Zimmerman commented he <br />thought that meant when North Fork connected with Wood Lawn Estates. Mr. Peck read Item #2 <br />Ordinary Access Road which states "The Developer hereby grants unto the City, for the use and <br />enjoyment of the public, an easement for roadway purposes over, under and across the right-of- <br />way ........... ""This easement shall expire upon the dedication in recorded plats of one or <br />more public roads providing access from the southeast comer of Lot 2, Block 3, North Fork, <br />across Outlot C, Northfork, to a public road west of Outlot C, North Fork". <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners LaDue, Bawden, Deemer, <br />Terry and Thorud. Voting No: None.
