Attachment C Summary of Proposed Changes 9.11.11 Permitted Encroachments. The following shall not be considered as encroachments on setbacks and height requirements of the City, Code: a. In any=Y~ yard: off-street parking spaces, terraces, awnings, canopies, steps, chimneys,~e~-s; b. Fences, walls and hedges: notwithstanding any other provisions of this City Code, fences, walls, and hedges are permitted in or along the edge of any residential yard; c. In rear yards: recreational and laundry drying equipment, arbors and trellises, balconies, breezeways, open porches, detached outdoor living rooms and private garages, providing a setback of five. (5) feet or the depth of any existing easements, whichever is greater, is maintained; d. Height limitations shall not apply to barns, silos, and other structures on farms, church spires, belfries, .cupolas and domes, monuments, water towers, fire and hose towers, observation towers, chimneys and smokestacks, #~~eles, telephone poles, and parapet walls not extending more than four feet above the limiting height of the building. 9.12.03 General Provisions. Subd. 11. Flags. The display of flags shall be permitted in all districts. However, the total square footage area of any €lags-flag used as advertising copy or as attention getting devices for commercial purposes shall be considered as permanent signage and counted towards the total allowable sign area ` permitted by this Section for the parcel on which the flag(s) is displayed. ~1~` L,°~~'~+ ~~ The hei~Yht of a fla<g=pole may not exceed forty~40) feet, or the building_hei~ht limits for the underlying zoning district where the pole is located, whichever is less. Flag=poles are subiect to a setback equal to the height of the flag=pole from all property lines or public parking areas, If en.aineered flag=pole footings are installed, flag=poles may be located within ten (1.0) feet of property lines or public parking lots. A building_permit must be issued prior to the installation of any fla~~pole with footings Footings for flagpoles are subject to review bxtlle Building Official or his/her designee and must meet standards based on the Minnesota State Building Code to qualify for a ten (10) foot setback: The display of flans on flagpoles may not cover more than fifthpercent of (50%) of the height of the flay-pole.
