<br />Mike Max, Chair of the EPB, stated that to address the attendance issue, Mr. Sibilski did try to <br />attend meetings by phone when he was out of town, but he was advised not to do. <br /> <br />Councilmember Dehen stated that at the Work Session meeting, Mr. Sibilski indicated that if he <br />had to do it over again, he would do it the same way. <br /> <br />Mr. Sibilski stated that he did make efforts to be part of the meetings. He stated that he did say <br />in the Work Session that he would have perhaps worded the letter differently although he still <br />would have sent it. He stated that he doesn't think that, because people serve on a Board or <br />Commission, their opinions should have to be censored. <br /> <br />Mayor Ramsey stated that he feels that Mr. Sibilski could have come and spoken to him rather <br />than send the letter and agrees that Mr. Sibilski had every right to write the letter. <br /> <br />Motion by Councilmember Jeffrey, seconded by Councilmember Elvig, to allow Mr. Sibilski to <br />continue to serve on the EPB for the duration of his term. <br /> <br />Further Discussion: Councilmember Wise stated that he has problems with Mr. Sibilski getting <br />his facts from the newspaper. Councilmember McGlone read aloud a comment from the letter <br />sent by Mr. Sibilski, which he found offensive. <br /> <br />Motion failed. Voting Yes: Councilmembers Jeffrey, Elvig and Dehen. Voting No: Mayor <br />Ramsey and Councilmembers Look and McGlone. Abstaining: Councilmember Wise. <br /> <br />Motion by Councilmember McGlone, seconded by Mayor Ramsey, to remove Mr. Sibilski from <br />the EPB, based on his attendance violations. <br /> <br />Further Discussion: Councilmember Jeffrey stated that he feels it is unfortunate that this is a <br />motion on an attendance violation, when the majority of the discussion has been on the letter and <br />Code of Conduct. Councilmember Dehen stated that he disagrees and feels here has been ample <br />discussion on attendance tonight. <br /> <br />Amended motion by Councilmember McGlone, seconded by Mayor Ramsey, to remove Mr. <br />Sibilski from the EPB, based on violations in the Code of Conduct and the attendance policy and <br />adopt Resolution #09-04-080A confirming any direction given at the work session related to the <br />removal of a Commissioner. . <br /> <br />Further Discussion: City Attorney Goodrich noted that April 15, 2009 would be the effective <br />termination date, which needs to be included in the motion. <br /> <br />Amended motion by Councilmember McGlone, seconded by Mayor Ramsey, to make the <br />removal effective on April 15, 2009. <br /> <br />Further Discussion: City Attorney Goodrich stated that there should be discussion of a finding <br />on what the Council thinks Mr. Sibilski has done and read some of the wording regarding the <br /> <br />City Council / April 14, 2009 <br />Page 14 of 17 <br />
