<br />Highway 47 was upgraded the City was required to gain access controls on properties from the <br />Riverside Company or it's subsidiaries and that was all part of the purchase agreement. The <br />eastern half of the bluff would be protected as part of DNR regulations. The City is asking for a <br />conservation easement to protect the tree line and save as many trees as possible. The <br />conservation easement would protect the 50% open space. <br /> <br />Commissioner VanScoy questioned if there has been an opportunity to bring the park dedication <br />concern from the sketch plan review of this parcel to the Park and Recreation Commission. <br /> <br />Associate Planner Gladhill stated there has and the Park and Recreation Commission agreed we <br />should pursue to permanently protect the park. Staff is in the process of figuring out the best way <br />to proceed so the document recorded doesn't prevent putting future park structures, such as a <br />band shell, maintenance building or something that would be for the public good on the parcel. <br />The Parks Department is working on this process. <br /> <br />Ed Youngquist, Riverside Companies presented an exhibit that showed the conservation <br />easement. <br /> <br />Mr. Edmundson stated he wants to make sure the density stays at 7-15 per acre, the park does get <br />dedicated and the tree line is maintained. <br /> <br />Mr. Youngquist stated that when they looked at this use they looked at filling a community need. <br />Also in the design of the site they have tried to minimize any kind of impact to the environment. <br />They are requesting a PUD to be able to pull the building forward to save the tree line. They are <br />creating a buffer between commercial and residential with a real nice looking building, it is a <br />quiet development, the residents are non-drivers so the impact to the traffic is less than if they <br />would develop as a straight R-3 high density residential development. <br /> <br />Mr. Youngquist continued that at one time they had two buildings shown; however, as they move <br />forward they are looking at expanding the existing building because of Department of Health <br />regulations. He stated they are working with the City to address the park concerns. He suggested <br />dedicating the park on the subdivision. The residents will than be assured they will not lose a <br />park in the future. He stated they want to work with the residents and the City. <br /> <br />Commissioner Cleveland asked how do you designate it specifically for seniors and how can we <br />be sure it remains that. <br /> <br />Brian Wingess, owner of Comforts of Home, stated assisted senior living is all they do. He <br />explained the different levels of senior assisted living. They currently have six facilities in the <br />. Twin Cities and have seven under development. <br /> <br />Philip Rolf, 4869 142nd Lane, asked what the setback to the river front was. <br />Associate Planner Gladhill stated there is 75 foot setback from the ordinary high water line, as <br />per the Wild and Scenic Overlay District standards. He reiterated that Staff has not seen a plan <br />for that and Comforts of Home would have to bring in a site plan for review at the time of <br />expanSIOn. <br /> <br />Planning Commission/June 4, 2009 <br />Page 4 of7 <br />
