<br />Councilmember Wise noted that Councilmember McGlone's company had done work <br />successfully for the City before he became a Councilmember. He stated that he agrees that this <br />was the best bid and he feels Councilmember McGlone is the best man for the job. <br /> <br />Councilmember Jeffrey stated that he has concerns about the separation of Councilmember <br />McGlone's duties and contractor duties. He asked how staff will report any inappropriate <br />activity or mannerism by Councilmember McGlone and how they would be dealt with <br />objectively. <br /> <br />Mayor Ramsey stated that he feels that these concerns were addressed at the Work Session on <br />June 30, 2009 and Police Chief Way would be "the boss" at that point. <br /> <br />Councilmember Look reiterated that Councilmember McGlone is the lowest, responsible bidder. <br /> <br />City Attorney Goodrich reiterated that this was not a bid process, but an RFP. <br /> <br />Councilmember Elvig stated that he likes the idea of reviewing this contract in a year, so any <br />issues can be addressed. He stated that he wants people to be assured that Councilmember <br />McGlone did not see other people's proposals and noted that Councilmember McGlone is the <br />only one of the bidders who has all the necessary equipment to do this work. He noted that the <br />bids are not even close, and in some cases, they were 30-70% below the other proposals. <br /> <br />Councilmember Dehen asked if there would be indemnification language included because <br />Councilmember McGlone would be a contractor. <br /> <br />City Attorney Goodrich noted that there can be language included for this purpose. He stated <br />that he can check with the League of Minnesota Cities and see if they have any additional <br />language to be added. He stated that he feels that Councilmember McGlone will make sure that <br />the line of demarcation will be clear between his role as Councilmember and contractor. <br /> <br />City Attorney Goodrich noted that two resolutions are needed, and reviewed some language <br />changes. <br /> <br />City Attorney Goodrich noted that the mowing contractor could be included in this resolution. <br />He-noted that TRG Snow and Lawn Care was selected at the June 30, 2009 Work Session. <br /> <br />Motion by Councilmember Look, seconded by Councilmember Elvig, to Adopt Resolution #09- <br />143 authorizing staffto formally enter into a one-year contract subject to Mn Statute 471.88 et. <br />Seq. with Contractors and Consultants, Inc. d/b/a Remove-All; AND that the mowing contract be <br />given to TRG Snow and Lawn Care. <br /> <br />Further Discussion: Councilmember Dehen noted that he has questions about the mowing <br />portion of the contract and the requirement of 14 days of continuous notice.
