He advised that even though the State Statute allows <br />for the use of A TV s on roads, the City ordinance is more restrictive and does not allow for that <br />type of use. <br /> <br />Councilmember Wise questioned if complaints were generated from people using A TV s in their <br />own yards. <br /> <br />Police Chief Way confirmed that they do receive complaint~ of that nature. He advised that it is <br />only legal to ride snowmobiles and A TV s north of the MUSA line. He stated that if the police <br />see that type of activity, they would not stop to issue a ticket but would issue tickets on a <br />complaint basis. He reported that previously a resident had built a motocross track, which <br />caused many complaints from the neighboring properties. <br /> <br />Councilmember Elvig stated that there is a provision as to what time of year an A TV could be <br />used, as damage occurred from use in the spring. He stated that an A TV is different from a car <br />in that you cannot predict what they are going to do next and they are. able to turn in a different <br />capacity. <br /> <br />Mayor Ramsey had a problem withthe concept that if you ride a four-wheeler and you are doing <br />things you should not that you would ruin things for everyone. He thought that those people <br />should be ticketed. <br /> <br />Councilmember Look was amused that people get upset about their neighbors riding a four- <br />wheeler around the yard or neighborhood when that same person may spend two hours mowing <br />their lawn, which would generate the same amount of noise. <br /> <br />Police Chief Way advised that those types of things are covered under the public nuisance <br />ordinance, and it would depend on whether the activity was natural or un-natural. <br /> <br />Councilmember Look thought that some residents would complain about any type of noise and <br />did not think that an ordinance should be crafted to suit that type of person. <br /> <br />Councilmember Dehen confirmed that the City ordinance was more restrictive than State Statute. <br /> <br />There was consensus to make changes to the ordinance. <br /> <br />Councilmember Look stated that some residents currently plow their driveways with four <br />wheelers and was concerned that would be in violation of the ordinance. <br /> <br />Councilmember Dehen suggested trying something similar to the City of Anoka crulSlng <br />ordinance, as it seemed that problem was with repetitive behavior. <br /> <br />Police Chief Way confirmed he would need more direction from the Council as to the direction <br />they would like to go with the ordinance. <br /> <br />City Council Work Session / July 28, 2009 <br />Page 4 of9 <br />
