Motion by Mayor Ramsey, seconded by Councilmember Elvig, to Adopt Ordinance No. 09-11 declaring Lot 3, Block 1, Sunfish Lake Business Park Third Addition as surplus property and authorizing its sale. A Roll Call vote was performed by the Recording Secretary. Case #4: Adopt Resolution #09-07-XXX Ratifying Change Order No. 1 for Improvement Project #08-27, Water Tower #3. City Engineer Himmer reviewed the staff report. Councilmember Wise questioned what the contingency is in the original bid. City Engineer Himmer explained that the bid came in well under estimated cost and there was no contingency budgeted. Councilmember Look was not opposed to moving the tower but was concerned with the possibility that Highway 47 may eventually expand, and how the City could liquidate the property originally purchased. He understood that work was underway but wanted to ensure that a master plan had been developed for the area, and what could be done around it, on the City owned property. City Engineer Himmer stated that any future development would require ponding and that could be provided on this site by reconfiguring the pond to fit ultimate development, or by requiring the developers to pay into the ponding as development occurs. Councilmember Dehen understood that the request to move the tower was being requested because of the. amount of clay and questioned why that was not determined from the soil borings. He was concerned that clay could. be found in the new location as well, and questioned what would be done if that were to occur. City Engineer Himmerexplained that the soil borings had been done in the new proposed location and no corrections would need to be done in excess of the amount stated.
