Attorney Goodrich advised that there were also some issues in regard to encroachment <br />that would need to be worked out as well. <br /> <br />Councilmember Jeffrey questioned if something would be communicated through the weekly <br />update that this item had been completed. <br /> <br />Attorney Goodrich stated that the closing was scheduled for August 8, 2009, and advised that it <br />would not close unless done correctly. He confirmed that an update would be given through the <br />weekly update. He stated that the old Holiday Station store property had been closed on and the <br />City now owns that piece of property. <br /> <br />Councilmember Look confirmed that staff time was not being charged to the City. He <br />questioned if the City would be liable for maintenance of the lot. <br /> <br />Attorney Goodrich stated that staff time would be paid by RALF at this time. <br /> <br />Economic Development Coordinator Sullivan confirmed that the City would not be liable for <br />maintenance. <br /> <br />Case #3: <br /> <br />Adopt Ordinance Declaring Land as Surplus Property and Authorizing the <br />Sale of Lot 3, Block 1, Sunfish Lake Business Park Third Addition. <br /> <br />Economic Development Coordinator Sullivan reviewed the staff report. <br /> <br />Attorney Goodrich did not think that the ordinance would need to be changed because the <br />property was being declared surplus property. He explained that by adopting this ordinance, the <br />Council would be allowing the entire parcel to be sold. <br /> <br />Councilmember Dehen questioned what would make the property surplus. <br /> <br />Attorney Goodrich explained that it is property that is not needed for public purpose, such as <br />right-of-way or public facility, and would then become surplus property. <br /> <br />Councilmember Dehen questioned if the Council was the determining body on what is or is not <br />surplus property. <br /> <br />Attorney Goodrich stated the Charter indicates that a sale ordinance would need to be adopted in <br />this regard. He advised that this process would give the public an opportunity to petition against <br />passage of the ordinance to stop the sale. He stated that an ordinance would need to be crafted <br />for each parcel that would be sold, or one ordinance could be passed for the entire area. <br /> <br />Councilmember Dehn questioned if the City would need to sell to a low bid, even if that is a very <br />low offer. <br /> <br />Attorney Goodrich stated that they City would not have to accept a low offer if they chose not to <br />do so. <br /> <br />City Council!
