CASE # 9 <br />AUTHORIZE CONTRACT FOR ROOF REPAIRS AT WOODLAND GREEN PARK, <br />SOLSTICE PARK, AND ELMCREST PARK <br />By: Heidi Nelson, Deputy City Administrator/Director of Community Development <br />Background: <br />On May 25th, 2008, a severe thunderstorm caused significant hail damage throughout the City. The <br />League of Minnesota Cities .(LMNC) conducted an assessment of the damages, and subsequently, <br />roof replacement was completed on the buildings at Central Park. <br />Roof replacement is also required on the shelters at Woodland Green Park, Solstice Park, and <br />Elmcrest Park. Staff has secured three (3) quotes for roof replacement at the above-mentioned <br />parks. Since LMNC will pay for damages based on like material replacement, it was required that <br />all bids had to include pricing for like material replacement. In addition, the city requested quotes <br />on a material upgrade specified by staff (Kasselwood product). Recently staff has transitioned to <br />utilizing a metal roofing material in parks due to the reduced vandalism and hail damage <br />experienced with a metal vs shingles/shakes type roofing product. Each of the contractors provided <br />pricing on an alternate material as well. Staff s experience has been very positive with the <br />Kasselwood product, thus this was the product specified when requesting quotes. The quote results <br />are as follows: <br />It should be noted that the company Contractors & Consutlants Inc. is owned by Councilmember <br />McGlone. The City Attorney has researched the provisions for contracting with a councilmember, <br />it is detailed below: <br />Minn. Stat Sec. 471.87 provides that no public officer who is authorized to make take <br />part in the authorizing of various public contracts may have a personal financial interest <br />in said contracts unless an exception is provided for in the statutes: Penalty for violation <br />is gross misdemeanor. <br />One exception is permitted by Minn Stat 471.88 Subd 5. which permits a contract with a <br />public officer when there is no competitive bid requirement AND the City Council by <br />unanimous vote authorizes the contract. The following procedure is to be followed: <br />1.
