CITY OF RAMSEY <br />CITY OF NOWTHEN <br />JOINT POWERS FIRE PROTECTION AGREEMENT <br />WHEREAS, The City of Ramsey ("Ramsey") and The City of Nowthen <br />("Nowthen") desire to cooperate in the provision of fire and rescue services to portions of <br />Ramsey and all of Nowthen for the purposes of increasing service capacity and <br />decreasing response time, and reducing the cost of providing fire and rescue services to <br />both communities; and <br />WHEREAS, Ramsey currently has an operating fire department consisting of two <br />fire stations, several fire and rescue apparatus, other fire.and rescue equipment, and a <br />complement of paid on-call firefighters and some full time fire staff, including a full time <br />fire chief (the "Fire Chief') and fire marshal (collectively the "Fire Department"); and <br />WHEREAS, Minnesota Statutes Section 471.59 authorizes two governmental <br />units by written agreement entered into through action of the governing bodies to jointly <br />or cooperatively exercise any power common to the contracting parties; and <br />WHEREAS, two or more governmental units through action of their governing <br />bodies by adoption of a joint powers agreement may establish a joint powers board <br />composed solely of members of the cooperating governing bodies; and <br />- -WHEREAS, the City of Ramsey is a charter city pursuant to Minnesota Statutes <br />410 et seq and the City of Nowthen is an Optional Plan A city pursuant to Minnesota <br />Statutes 412.541, Sub 2; and <br />WHEREAS, Minn. Stat. Section 412.221, Subd. 17 authorizes the City of <br />Nowthen to establish a fire department and Minn. Stat. Section 410.33 and the Ramsey <br />City Charter, Section 12.7 authorize Ramsey to enter into this Agreement; and <br />WHEREAS, after conference, study and deliberation, the respective City <br />Council's have found and hereby find it to be advisable to utilize selected buildings and <br />equipment jointly for use in preventing and extinguishing fires, and providing rescue <br />services within both jurisdictions and beyond; and <br />WHEREAS, the City of Ramsey and the City of Nowthen are herein setting forth <br />the terms and conditions agreed upon in this Joint Powers Agreement, in conformance <br />with Minnesota Statutes 471.59 (this "Agreement"); and <br />
