<br />6. Items that will count towards the number restriction include, but are not limited to, the <br />following examples: vehicles, RV's, campers, boats, canoes, snowmobiles, jet-skis, ATV's, <br />go-carts, motocross bikes, motorcycles, fish houses, and other recreational equipment. <br /> <br />7. Items that will not count towards the number restriction include those items typically seen as <br />accessory to a residential use. Examples would be lawnmowers, garden tractors and <br />attachments, bicycles, wheelbarrows, play structures, step ladders, and other items used for <br />routine home and lawn maintenance. <br /> <br />8. Items stored outside, even though they may comply with the number restriction, are still <br />subject to the public nuisance regulations in Chapter 5. <br /> <br />9. Equipment, as well as motorized vehicles, will be required to be stored or parked on a <br />prepared parking surface in the front and side yards. <br /> <br />10. The material for the prepared parking surface must be at least 2 inches in depth. It is reiterated' <br />that Code requires the surface to be applied under the entire vehicle or equipment and extend <br />12 inches beyond the perimeter of the vehicle or equipment. <br /> <br />11. Vehicles or equipment for a commercial use will count towards the maximum number of <br />items allowed to be parked or stored outside. <br /> <br />12. Screening requirements are proposed to be different for properties within the MUSA vs. those <br />outside the MUSA. In the non-MUSA area, vehicles and/or equipment shall be screened to a <br />degree of 50% at ground level view with landscaping or other means from the public right-of- <br />way and adjacent properties. In the MUSA area, vehicles and/or equipment shall continue to <br />meet the 75% screening requirement that currently exists in code. This is done primarily by <br />fencing or mature landscaping already in place. <br /> <br />Concern has been expressed about allowing the abatement program to work before moving ahead <br />with any ordinance changes. Also, what types of complaints are we seeing, are they number of <br />vehicles or junk vehicles, what exactly is the issue? City Staff did check with the Police Department, <br />and the complaint database,does not distinguish a difference between complaints based on number of <br />items being stored in a yard versus a complaint generated because of the condition of items being <br />stored outside. Since abatement was implemented in August of 2007, the Police Department has <br />performed 69 abatements to remove junk vehicles and debris from properties, and mow tall grass and <br />weeds. <br /> <br />CitY Staff also ,conducted a very cursory drive-by inspection of approximately 600 lots in April of. <br />2008. Of those, approximately 535 were less than 5 acres in size and about 25 parcels appeared to be <br />non-compliant with a 5 item restriction that was being proposed as part of the ordinance being <br />considered at that point. Approximately 65 of the lots viewed were more than 5 acres in size and of <br />those, 6 appeared to be non-compliant with the 8 item restriction being considered at that time. The <br />time of day of the drive-by inspections was between 2:00 and 3:30 p.m. It could be assumed that <br />more items may be stored outside once occupants return home at the end of the day.
